Dred Scott was still an enslaved person, therefore he was not a citizen and had no right to bring a lawsuit. Living on free soil supposedly did not make Scott free. A slave was property, and the fifth amendment prohibited the taking of property without due process. Congress had no power to ban slavery, therefore Taney stated the constitution protected slavery.
