What is a constructive notice?
*It refers to the notice provided by all recorded documents in property chain of title. *The purchaser has the duty to check the title for any prior recorded interest. *The purchaser is deemed to have constructive knowledge of any interest previously recorded in the chain of title.
What if the bona fide purchaser fails to make a reasonable inquiry?
Failure to make a reasonable inquiry is negligent and would defeat a bona fide purchase status.
When does inquiry notice arise?
It arises when facts exist that would create the suspicion of a reasonable prudent person and cause the person to investigate and inquire about that third person possible interest in that interest.
How many types of notices there are?
There are three types of notices: C - Constructive Notice I - Inquiry Notice A - Actual Notice
When does actual notice arise?
where you have orally or a document of the previous owner.
