Rehabilitation Act of 1973
1st major piece of federal legislation prohibiting disability discrimination
Sexual harassment
A form of sex discrimination under Title VII of the Civil Rights Act of 1964 and is actionable when it occurs between same as well as opposite sex individuals
Equal Employment Opportunity Commission (EEOC)
Enforces Title VII, the Civil Rights Act of 1991, the Equal Pay Act, the Age Discrimination in Employment Act, and the Americans with Disabilities Act (units of government most responsible for enforcing the regulations mentioned)
Disparate treatment
Intentional discrimination - employers apply different standards or treatment to different groups of employees or applicants based on a protected category ( race, color, sex, etc.)
Americans with Disabilities Act Amendments Act of 2008 (ADAAA)
Made several modifications to the way in which the definition of disability is interpreted and in doing so overturned previous Supreme Court verdicts for being too narrow in their interpretation of what constitutes a disability
"Bona fide occupational qualification (BFOQ)"
Orgs may hire employees based upon religion, sex, or national origin in those certain instances where religion, sex or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise.
Disparate impact
Unintentional discrimination occurs when a racially neutral employment practice has the effect of disproportionately excluding a group based upon a protected category
Pregnancy discrimination act of 1978
amended Title VII to protect pregnant women from employment discrimination
Civil Rights Act of 1991
became law, amending title VII. Additional remedies to deter harassment and intentional employment discrimination, to codify some disparate impact discrimination concepts, and to expand the scope of existing EEO statuses
Equal Pay Act
Amendment to Fair Labor Standards Act to eliminate differences in pay between men and women performing the same work
Affirmative Action
those actions appropriate to overcome the effects of past or present practices, policies, or other barriers to to equal eployment opportunity
