Writ of Habeas Corpus

A ____ __ ______ ______, also known as the great writ, is a summons with the force of a court order; it is addressed to the custodian (a prison official for example) and demands that a prisoner be taken before the court, and that the custodian present proof of authority, allowing the court to determine whether the custodian has lawful authority to detain the prisoner. If the custodian is acting beyond his or her authority, then the prisoner must be released. Any prisoner, or another person acting on his or her behalf, may petition the court, or a judge, for a writ of habeas corpus. One reason for the writ to be sought by a person other than the prisoner is that the detainee might be held incommunicado. Most civil law jurisdictions provide a similar remedy for those unlawfully detained, but this is not always called habeas corpus.[1] For example, in some Spanish-speaking nations, the equivalent remedy for unlawful imprisonment is the amparo de libertad ('protection of freedom').

Asserted that the ability of working men to achieve econom,ic independence was the basis of northern superiority. Northern working class men were concerned about competing with other workers and maintaining economic independence. The land in the west meant safety and a place they could continue to make a living and not have to worry about competition. If slavery were to move west, it would destroy that option because there would be less industrialization and they wouldn't be able to compete with slave labor.

It refers to a severe business cycle.[1] The phrase "boom and bust" pertains to capitalism.[2] Times of increased business and investment have seen these collapse leaving widespread poverty such as the depressions of 1837 and 1857 in the United States.[3] For example, in the early 1800s in Ohio people were buying land on credit to sell at twice the price but land became too expensive to buy. At the same time, wheat prices became too low to transport wheat to market. Wheat was $1.50 per bushel in 1816; by 1821, 20 cents.[4] In 1894 someone wrote, "Of course it stood to reason that the music hall boom would bust sooner or later . . . In fact the boom has busted and according to the published balance sheet the Alhambra has suffered as much as the rest in consequence."[5] Business leaders such as automaker Paul Hoffman have used the phrase in calling for increased civic responsibility toward taming the business cycle; he also said, "we cannot live with a crash" in reference to 26 depressions over 100 years including "the bust" of the 1930s.[6] Some authors have used "boom and bust" to define the business cycle.[7] Other ways of saying unwanted changes sales have been used, such as "more volatile cycle."[8] William Forbes uses the phrase in his textbook on finance, in which he identifies credit characteristics of boom and of bust:

Coercive Acts

The Intolerable Acts was the American Patriots' name for a series of punitive laws passed by the British Parliament in 1774 after the Boston Tea party. They were meant to punish the Massachusetts colonists for their defiance in throwing a large tea shipment into Boston harbor. In Great Britain, these laws were referred to as the Coercive Acts. The acts took away Massachusetts self-government and historic rights, triggering outrage and resistance in the Thirteen Colonies. They were key developments in the outbreak of the American Revolution in 1775.

Proclamation Line of 1763

The Royal Proclamation of 1763 was issued October 7, 1763, by King George III following Great Britain's acquisition of French territory in North America after the end of the French and Indian War/Seven Years' War, in which it forbade all settlers from settling past a line drawn along the Appalachian Mountains,[1]The purpose of the proclamation was to organize Great Britain's new North American empire and to stabilize relations with Native North Americans through regulation of trade, settlement, and land purchases on the western frontier. The Royal Proclamation continues to be of legal importance to First Nations in Canada and is significant for the variation of indigenous status in the United States. It eventually ensured that British culture and laws were applied in Upper Canada after 1791, which was done to attract British settlers to the province. Its geographic location is similar to the Eastern Continental Divide's path running northwards from Georgia to the Pennsylvania-New York State border, and north-eastwards past the drainage divide on the "St. Lawrence Divide" from there northwards through New England.

Salem Witchcraft

The Salem witch trials were a series of hearings and prosecutions of people accused of witchcraft in colonial Massachusetts between February 1692 and May 1693. The trials resulted in the executions of twenty people, most of them women. Despite being generally known as the Salem witch trials, the preliminary hearings in 1692 were conducted in several towns in the Province of Massachusetts Bay: Salem Village (now Danvers), Ipswich, Andover, and Salem Town.

The United States presidential _______ __ ____ was the 10th quadrennial presidential election, held from Tuesday, October 26, to Thursday, December 2, 1824. John Quincy Adams was elected President on February 9, 1825, after the election was decided by the House of Representatives in what was termed the Corrupt Bargain. The previous years had seen a one-party government in the United States, as the Federalist Party dissolved, leaving only the Democratic-Republican Party as a national political entity. In this election, the Democratic-Republican Party splintered as four separate candidates sought the presidency. This process did not yet lead to formal party organization, but later, the faction led by Andrew Jackson would evolve into the modern Democratic Party, while the factions led by John Quincy Adams and Henry Clay would become the National Republican Party (no relation to the current Republican Party) and then the Whig Party. The presidential election of 1824 is notable for being the only election since the passage of the Twelfth Amendment to the United States Constitution to have been decided by the House of Representatives in accordance with its provision to turn over the choice of the president to the House when no candidate secures a majority of the electoral vote. It was also the only presidential election in which the candidate who received the most electoral votes did not become president (since Andrew Jackson's plurality of electoral votes was insufficient to prevent the election from being thrown into the House of Representatives). The election of 1824 is the first in which the successful presidential candidate did not win the popular vote. Several states did not permit a popular vote, but rather allowed the state legislature to choose their electors. Lastly, this election marked the seventh consecutive presidential victory for the Democratic-Republican Party, which, to this day, is still the longest presidential winning streak in American history.

Election of 1800

The United States Presidential ______ __ ____ was the 4th quadrennial presidential election. It was held from Friday, October 31 to Wednesday, December 3, 1800. In what is sometimes referred to as the "Revolution of 1800,"[1][2] Thomas Jefferson defeated John Adams. The election was a realigning election that ushered in a generation of Democratic-Republican Party rule and the eventual demise of the Federalist Party in the First Party System. It was a long, bitter re-match of the 1796 election between the pro-French and pro-decentralization Democratic-Republicans under Jefferson and Aaron Burr, against incumbent Adams and Charles Pinckney's pro-British and pro-centralization Federalists. The chief political issues included opposition to the tax imposed by Congress to pay for the mobilization of the new army and the navy in the Quasi-War against France in 1798, and the Alien and Sedition Acts, by which Federalists were trying to stifle dissent, especially by Democratic-Republican newspaper editors. While the Democratic-Republicans were well organized at the state and local levels, the Federalists were disorganized, and suffered a bitter split between their two major leaders, President Adams and Alexander Hamilton. The jockeying for electoral votes, regional divisions, and the propaganda smear campaigns created by both parties made the election recognizably modern.[3] The election exposed one of the flaws in the original Constitution. Members of the Electoral College were authorized by the original Constitution to vote for two names for President. (The two-vote ballot was created in order to try to maximize the possibility that one candidate received votes from a majority of the electors nationwide; the drafters of the Constitution had not anticipated the rise of organized political parties, which made attaining a nationwide majority much easier.) The Democratic-Republicans had planned for one of the electors to abstain from casting his second vote for Aaron Burr, which would have led to Jefferson receiving one electoral vote more than Burr. The plan, however, was mishandled. Each elector who voted for Jefferson also voted for Burr, resulting in a tied electoral vote. The election was then put into the hands of the outgoing House of Representatives, which, after 35 votes in which neither Jefferson nor Burr obtained a majority, elected Jefferson on the 36th ballot.

Election of 1860

The United States presidential ______ __ ____ was the 19th quadrennial presidential election. The election was held on Tuesday, November 6, 1860 and served as the immediate impetus for the outbreak of the American Civil War. The United States had been divided during the 1850s on questions surrounding the expansion of slavery and the rights of slave owners. In 1860, these issues broke the Democratic Party into Northern and Southern factions, and a new Constitutional Union Party appeared. In the face of a divided opposition, the Republican Party, dominant in the North, secured a majority of the electoral votes, putting Abraham Lincoln in the White House with almost no support from the South. Before Lincoln's inauguration, seven Southern states declared their secession and later formed the Confederacy. Secessionists from four additional Border states joined them when Lincoln's call to restore federal property in the South forced them to take sides, and two states, Kentucky and Missouri, attempted to remain neutral. At the 1864 election, the Union had admitted Kansas, West Virginia, and Nevada as free-soil states, while the Civil War disrupted the entire electoral process in the South, as no electoral votes were cast by any of the eleven states that had joined the Confederacy.

New Jersey Plan

The ___ _____ ____ (also widely known as the Small State Plan or the Paterson Plan) was a proposal for the structure of the United States Government presented by William Paterson at the Constitutional Convention on June 15, 1787.[1] The plan was created in response to the Virginia Plan, which called for two houses of Congress, both elected with apportionment according to population.[2] The less populous states were adamantly opposed to giving most of the control of the national government to the more populous states, and so proposed an alternative plan that would have kept the one-vote-per-state representation under one legislative body from the Articles of Confederation. The New Jersey Plan was opposed by James Madison and Edmund Randolph (the proponents of the Virginia Plan).

13th Amendment

The removal included members of the Cherokee, Muscogee, Seminole, Chickasaw, and Choctaw nations, who chose not to assimilate with American society, from their ancestral homelands in the southeastern U.S. to an area west of the Mississippi River that had been designated as Indian Territory. Native Americans who chose to stay and assimilate were allowed to become citizens in their states and of the U.S.[1] The phrase "Trail of Tears" originated from a description of the removal of the Choctaw Nation in 1831.[2]

Bank War

The ____ ____ refers to the political struggle that developed over the issue of rechartering the Second Bank of the United States (BUS) during the Andrew Jackson administration (1829-1837).[1] Anti-Bank Jacksonian Democrats were mobilized in opposition to the national bank's re-authorization on the grounds that the institution conferred economic privileges on financial elites, violating U.S. constitutional principles of social equality.[2][3] The Jacksonians considered the Second Bank of the U.S. to be an illegitimate corporation whose charter violated state sovereignty and therefore it posed an implicit threat to the agriculture-based economy dependent upon the U.S. southern states' widely practiced institution of slavery.[4][5][6] With the Bank charter due to expire in 1836, the President of the Bank of the United States, acting like a central bank Nicholas Biddle, in alliance with the National Republicans under Senator Henry Clay (KY) and Senator Daniel Webster (MA), decided to make rechartering a referendum on the legitimacy of the institution in the general election of 1832.[7] When Congress voted to reauthorize the Bank, Jackson, as incumbent and candidate in the race, promptly vetoed the bill. His veto message justifying his action was a polemical declaration of the social philosophy of the Jacksonian movement[8] pitting "farmers, mechanics and laborers" against the "monied interest" and arguing against the Bank's constitutionality.[9] Pro-Bank National Republicans warned the public that Jackson would abolish the Bank altogether if granted a second term.[10] In the presidential campaigns of 1832, the BUS served as the central issue in mobilizing the opposing Jacksonian Democrats and National Republicans. Jackson and Biddle personified the positions on each side.[11] Jacksonians successfully concealed the incompatibility of their "hard money" and "paper money" factions in the anti-Bank campaign,[12] allowing Jackson to score an overwhelming victory against Henry Clay.[13] Fearing economic reprisals from Biddle and the Bank, Jackson moved swiftly to remove federal deposits from the institution. In 1833, he succeeded in distributing the funds to several dozen private banks throughout the country.[14] The new Whig Party emerged in opposition to his perceived abuse of executive power, officially censuring Jackson in the Senate.[15] In an effort to promote sympathy for the institution's survival, Biddle retaliated by contracting Bank credit, inducing a serious and protracted financial downturn.[16] A reaction set in throughout America's financial and business centers against Biddle's economic warfare,[17] compelling the Bank to reverse its tight money policies.[18] By the close of 1834, recharter was a "lost cause."[19] Rather than permitting the Bank to go out of existence, Biddle arranged its conversion to a state chartered corporation in Pennsylvania just weeks before its federal charter expired in March 1836. This episode in the Bank's decline and fall ended in 1841 with liquidation of the institution. Jackson's campaign against the Bank had triumphed.[20]

Whig Party

The ____ _____ was a political party active in the middle of the 19th century in the United States of America. Four Presidents of the United States were members of the Whig Party.[1] Considered integral to the Second Party System and operating from the early 1830s to the mid-1850s,[2] the party was formed in opposition to the policies of President Andrew Jackson and his Democratic Party. In particular, the Whigs supported the supremacy of Congress over the Presidency and favored a program of modernization and economic protectionism. This name was chosen to echo the American Whigs of 1776, who fought for independence, and because "Whig" was then a widely recognized label of choice for people who identified as opposing tyranny.[3] The Whig Party counted among its members such national political luminaries as Daniel Webster, William Henry Harrison, and their preeminent leader, Henry Clay of Kentucky. In addition to Harrison, the Whig Party also nominated war hero generals Zachary Taylor and Winfield Scott.

First Continental Congress

The ____ ________ ______ was a meeting of delegates from twelve of the thirteen colonies that met on September 5 to October 26, 1774 at Carpenters' Hall in Philadelphia, Pennsylvania, early in the American Revolution. It was called "The passage of the Coercive Acts" (also known as Intolerable Acts by the Colonial Americans) by the British Parliament. The Intolerable Acts had punished Massachusetts for the Boston Tea Party. The Congress was attended by 56 delegates appointed by the legislatures of the thirteen colonies which were hoping for British assistance with Native American problems on its frontier.[1] The Congress met briefly to consider options, including an economic boycott of British trade; rights and grievances; and petitioned King George III for redress of those grievances. The Congress also called for another Continental Congress in the event that their petition was unsuccessful in halting enforcement of the Intolerable Acts. Their appeal to the Crown had no effect, and so the Second Continental Congress was convened the following year to organize the defense of the colonies at the onset of the American Revolutionary War. The delegates also urged each colony to set up and train its own militia.

Alien and Sedition Acts

The _____ ___ ________ ___ were four bills that were passed by the Federalists in the 5th United States Congress and signed into law by President John Adams in 1798, the result of the French Revolution and during an undeclared naval war with France, later known as the Quasi-War. Authored by the Federalists, the laws were purported to strengthen national security, but critics argued that they were primarily an attempt to suppress voters who disagreed with the Federalist party.[1]

Stamp Act

The _____ ___ of 1712 was an act passed in the United Kingdom on August 1, 1712 to create a new tax on publishers, particularly of newspapers.[1][2][3] Newspapers were subjected to tax and price increased. The stamp tax was a tax on each newspaper and thus hit cheaper papers and popular readership harder than wealthy consumers (because it formed a higher proportion of the purchase price). It was increased in 1797, reduced in 1836 and was finally ended in 1855, thus allowing a cheap press. It was enforced until its repeal in 1855.[4] The initial assessed rate of tax was one penny per whole newspaper sheet, a halfpenny for a half sheet, and one shilling per advertisement contained within.[5] The act had a potentially chilling effect on publishers; Jonathan Swift was a frequent publisher of newspapers, and complained in a letter[6] about the new tax. Other than newspapers, it required that all pamphlets, legal documents, commercial bills, advertisements, and other papers issued the tax.[7] The tax is blamed for the decline of English literature critical of the government during the period, notably with The Spectator ending the same year of the tax's enactment.[8] It would see increasingly greater taxes and wider spectrum of materials affected until its repeal in 1855.

Boston Massaccre

The _____ _______, known as the Incident on King Street by the British,[2] was an incident on March 5, 1770, in which British Army soldiers killed five male civilians and injured six others. British troops had been stationed in Boston, capital of the Province of Massachusetts Bay, since 1768 in order to protect and support crown-appointed colonial officials attempting to enforce unpopular Parliamentary legislation. Amid ongoing tense relations between the population and the soldiers, a mob formed around a British sentry, who was subjected to verbal abuse and harassment. He was eventually supported by eight additional soldiers, who were subjected to verbal threats and thrown objects. They fired into the crowd, without orders, instantly killing three people and wounding others. Two more people died later of wounds sustained in the incident.

Three Fifths Compromise

The _____-_____ _________ was a compromise reached between delegates from southern states and those from northern states during the 1787 United States Constitutional Convention. The debate was over if, and if so, how, slaves would be counted when determining a state's total population for legislative representation and taxing purposes. The issue was important, as this population number would then be used to determine the number of seats that the state would have in the United States House of Representatives for the next ten years, and to determine what percentage of the nation's direct tax burden the state would have to bear. The compromise was proposed by delegates James Wilson and Roger Sherman.

Articles of Confederation

The ______ __ __________, formally the Articles of Confederation and perpetual Union, was a document signed amongst the 13 original colonies that established the United States of America as a confederation of sovereign states and served as its first constitution.[1] Its drafting by a committee appointed by the Second Continental Congress began on July 12, 1776, and an approved version was sent to the states for ratification in late 1777. The formal ratification by all 13 states was completed in early 1781. Even when not yet ratified, the Articles provided domestic and international legitimacy for the Continental Congress to direct the American Revolutionary War, conduct diplomacy with Europe and deal with territorial issues and Native American relations. Nevertheless, the weakness of the government created by the Articles became a matter of concern for key nationalists. On March 4, 1789, general government under the Articles was replaced with the federal government under the U.S. Constitution.[2][3] The new Constitution provided for a much stronger federal government with a chief executive (the president), courts, and taxing powers.

Albany Plan of Union

The ______ ____ __ _____ was a proposal to create a unified government for the Thirteen Colonies, suggested by Benjamin Franklin, then a senior leader (age 48) and a delegate from Pennsylvania, at the Albany Congress in July 1754 in Albany, New York. More than twenty representatives of several northern and mid-Atlantic colonies had gathered to plan their defense related to the French and Indian War, the front in North America of the Seven Years' War between Great Britain and France. The Plan represented one of multiple early attempts to form a union of the colonies "under one government as far as might be necessary defense and other general important purposes."[1] sharp increase of interest in religion, a profound sense of conviction and redemption on the part of those affected, an increase in evangelical church membership, and the formation of new religious movements and denominations.

Seneca Falls Convention

The ______ ____ _________ was the first women's rights convention.[1] It advertised itself as "a convention to discuss the social, civil, and religious condition and rights of woman".[2] Held in Seneca Falls, New York, it spanned two days over July 19-20, 1848. Attracting widespread attention, it was soon followed by other women's rights conventions, including one in Rochester, New York two weeks later. In 1850 the first in a series of annual National Women's Rights Conventions met in Worcester, Massachusetts.

Wilmot Proviso

The ______ ______, one of the major events leading to the American Civil War, would have banned slavery in any territory to be acquired from Mexico in the Mexican War; or, in the future, including the area later known as the Mexican Cession (which some proponents construed to also include the disputed lands in south Texas and New Mexico east of the Rio Grande).[1] Congressman David Wilmot first introduced the Proviso in the United States House of Representatives on August 8, 1846, as a rider on a $2,000,000 appropriations bill intended for the final negotiations to resolve the Mexican-American War (this was only three months into the two-year war). It passed the House but failed in the Senate, where the South had greater representation. It was reintroduced in February 1847 and again passed the House and failed in the Senate. In 1848, an attempt to make it part of the Treaty of Guadalupe Hidalgo also failed. Sectional political disputes over slavery in the Southwest continued until the Compromise of 1850.

Glorious Revolution

The ______ _________,[b] also called the Revolution of 1688, was the overthrow of King James II of England (James VII of Scotland and James II of Ireland) by a union of English Parliamentarians with the Dutch stadtholder William III of Orange-Nassau (William of Orange). William's successful invasion of England with a Dutch fleet and army led to his ascending of the English throne as William III of England jointly with his wife Mary II of England.

Puritans

The ______ were a group of English Protestants in the 16th and 17th centuries, including, but not limited to, English Calvinists. Puritanism in this sense was founded by John Calvin from the clergy shortly after the accession of Elizabeth I of England in 1558, as an activist movement within the Church of England.

Kansas-Nebraska Act

The ______-_______ ___ of 1854 (10 Stat. 277) created the territories of Kansas and Nebraska, opening new lands for settlement, and had the effect of repealing the Missouri Compromise of 1820 by allowing white male settlers in those territories to determine through popular sovereignty whether they would allow slavery within each territory. The act was designed by Democratic Senator Stephen A. Douglas of Illinois. The initial purpose of the Kansas-Nebraska Act was to open up many thousands of new farms and make feasible a Midwestern Transcontinental Railroad. It became a problem when popular sovereignty was written into the proposal so that the voters of the moment would decide whether slavery would be allowed or not. The result was that pro- and anti-slavery elements flooded into Kansas with the goal of voting slavery up or down, leading to Bleeding Kansas.[1]

Virginia Plan

The _______ ____ (also known as the Randolph Plan, after its sponsor, or the Large-State Plan) was a proposal by Virginia delegates for a bicameral legislative branch.[1] The plan was drafted by James Madison while he waited for a quorum to assemble at the Constitutional Convention of 1787.[2][3] The Virginia Plan was notable for its role in setting the overall agenda for debate in the convention and, in particular, for setting forth the idea of population-weighted representation in the proposed national legislature.

Atlantic Slave Trade

The vast majority of those enslaved that were transported to the New World, many on the triangular trade route and its Middle Passage, were West Africans from the central and western parts of the continent sold by West Africans to Western European slave traders, or by direct European capture to the Americas. The numbers were so great that Africans who came by way of the slave trade became the most numerous Old-World immigrants in both North and South America before the late 18th century.[1] Far more slaves were taken to South America than to the north. The South Atlantic economic system centered on producing commodity crops, and making goods and clothing to sell in Europe, and increasing the numbers of African slaves brought to the New World. This was crucial to those Western European countries which, in the late 17th and 18th centuries, were vying with each other to create overseas empires.[2]

Second Great Awakening

The _______ _____ _________ was a Protestant revival movement during the early 19th century in the United States. The movement began around 1790, gained momentum by 1800, and after 1820 membership rose rapidly among Baptist and Methodist congregations whose preachers led the movement. It was past its peak by the late 1840s. It has been described as a reaction against skepticism, deism, and rationalism, although why those forces became pressing enough at the time to spark revivals is not fully understood.[1] It enrolled millions of new members in existing evangelical denominations and led to the formation of new denominations. These revivals were part of a much larger movements that were sweeping across Europe at the time, mainly throughout England,

Monroe Doctrine

The _______ _______ was a US foreign policy regarding Latin American countries in 1823. It stated that further efforts by European nations to colonize land or interfere with states in North or South America would be viewed as acts of aggression, requiring U.S. intervention.[1] At the same time, the doctrine noted that the United States would neither interfere with existing European colonies nor meddle in the internal concerns of European countries. The Doctrine was issued in 1823 at a time when nearly all Latin American colonies of Spain and Portugal had achieved or were at the point of gaining independence from the Portuguese and Spanish Empires; Peru consolidated its independence in 1824, and Bolivia would become independent in 1825, leaving only Cuba and Puerto Rico under Spanish rule. The United States, working in agreement with Britain, wanted to guarantee that no European power would move in.[2] President James Monroe first stated the doctrine during his seventh annual State of the Union Address to Congress. The term "Monroe Doctrine" itself was coined in 1850.[3] By the end of the nineteenth century, Monroe's declaration was seen as a defining moment in the foreign policy of the United States and one of its longest-standing tenets. It would be invoked by many U.S. statesmen and several U.S. presidents, including Ulysses S. Grant, Theodore Roosevelt, John F. Kennedy, Ronald Reagan and many others.

Louisiana Purchase

The _______ ________ (French: Vente de la Louisiane "Sale of Louisiana") was the acquisition by the United States of America in 1803 of 828,000 square miles (2,144,000 square kilometers or 529,920,000 acres) of France's claim to the territory of Louisiana. The U.S. paid 50 million francs ($11,250,000) plus cancellation of debts worth 18 million francs ($3,750,000), a total sum of 15 million dollars (around 4 cents per acre[1]), for the Louisiana territory ($236 million in 2013 dollars, less than 42 cents per acre).[2][3] The Louisiana territory encompassed all or part of 15 present U.S. states and two Canadian provinces. The land purchased contained all of present-day Arkansas, Missouri, Iowa, Oklahoma, Kansas, and Nebraska; parts of Minnesota that were west of the Mississippi River; most of North Dakota; most of South Dakota; northeastern New Mexico; northern Texas; the portions of Montana, Wyoming, and Colorado east of the Continental Divide; Louisiana west of the Mississippi River, including the city of New Orleans; and small portions of land that would eventually become part of the Canadian provinces of Alberta and Saskatchewan.

Northwest Ordnance

The _______ ________ (formally An Ordinance for the Government of the Territory of the United States, North-West of the River Ohio, and also known as the Freedom Ordinance or The Ordinance of 1787) was an act of the Congress of the Confederation of the United States (the Confederation Congress), passed July 13, 1787. The ordinance created the Northwest Territory, the first organized territory of the United States, from lands beyond the Appalachian Mountains, between British Canada and the Great Lakes to the north and the Ohio River to the south. The upper Mississippi River formed the Territory's western boundary. On August 7, 1789, first President George Washington signed a replacement, the Northwest Ordinance of 1789, in which the new U.S. Congress reaffirmed the Ordinance with slight modifications under the newly effective Constitution of the United States. The Ordinance purported to be not merely legislation that could later be amended by the Congress, but rather "the following articles shall be considered as Articles of compact between the original States and the people and states in the said territory, and forever remain unalterable, unless by common consent...."[1]

Hartford Convention

The _______ ________ was a series of meetings from December 15, 1814 - January 5, 1815 in Hartford, Connecticut, United States, in which New England Federalists met to discuss their grievances concerning the ongoing War of 1812 and the political problems arising from the federal government's increasing power. Despite radical outcries among Federalists for New England secession and a separate peace with Great Britain, moderates outnumbered them and extreme proposals were not a major focus of the debate.[1] The convention discussed removing the three-fifths compromise which gave slave states more power in Congress and requiring a two-thirds super majority in Congress for the admission of new states, declarations of war, and laws restricting trade. The Federalists also discussed their grievances with the Louisiana Purchase and the Embargo of 1807. However, weeks after the convention's end, news of Major General Andrew Jackson's overwhelming victory in New Orleans swept over the Northeast, discrediting and disgracing the Federalists, resulting in their elimination as a major national political force.

Declaration of Independence

The ________ __ _________ is the usual name of a statement adopted by the Continental Congress on July 4, 1776, which announced that the thirteen American colonies,[2] then at war with Great Britain, regarded themselves as thirteen newly independent sovereign states, and no longer a part of the British Empire. Instead they formed a new nation—the United States of America. John Adams was a leader in pushing for independence, which was unanimously approved on July 2. A committee of five had already drafted the formal declaration, to be ready when Congress voted on independence. The term "Declaration of Independence" is not used in the document itself. Adams persuaded the committee to select Thomas Jefferson to compose the original draft of the document,[3] which Congress would edit to produce the final version. The Declaration was ultimately a formal explanation of why Congress had voted on July 2 to declare independence from Great Britain, more than a year after the outbreak of the American Revolutionary War. The national birthday, Independence Day, is celebrated on July 4, although Adams wanted July 2.

Virginia And Kentucky Resolutions

The ________ ___ ________ _________ (or Resolves) were political statements drafted in 1798 and 1799, in which the Kentucky and Virginia legislatures took the position that the federal Alien and Sedition Acts were unconstitutional. The resolutions argued that the states had the right and the duty to declare unconstitutional any acts of Congress that were not authorized by the Constitution. In doing so, they argued for states' rights and strict constructionism of the Constitution. The Kentucky and Virginia Resolutions of 1798 were written secretly by Vice President Thomas Jefferson and James Madison, respectively. The principles stated in the resolutions became known as the "Principles of '98". Adherents argue that the states can judge the constitutionality of central government laws and decrees. The Kentucky Resolutions of 1798 argued that each individual state has the power to declare that federal laws are unconstitutional and void. The Kentucky Resolution of 1799 added that when the states determine that a law is unconstitutional, nullification by the states is the proper remedy. The Virginia Resolutions of 1798 refer to "interposition" to express the idea that the states have a right to "interpose" to prevent harm caused by unconstitutional laws. The Virginia Resolutions contemplate joint action by the states.

Mayflower Compact

The ________ _______ was the first governing document of Plymouth Colony. It was written by separatist Congregationalists who called themselves "Saints". Later they were referred to as Pilgrims or Pilgrim Fathers. They were fleeing from religious persecution by King James of England. They traveled aboard the Mayflower in 1620 along with adventurers, tradesmen, and servants, most of whom were referred to, by the Separatists as "Strangers".

Missouri Compromise

The ________ _________ was a federal statute in the United States that regulated slavery in the country's western territories. The compromise, devised by Henry Clay, was agreed to by the pro-slavery and anti-slavery factions in the United States Congress and passed as a law in 1820. It prohibited slavery in the former Louisiana Territory north of the parallel 36°30′ north, except within the boundaries of the proposed state of Missouri. The passage of the Missouri Compromise took place during the presidency of James Monroe. This compromise was effectively repealed by the Kansas-Nebraska Act, submitted to Congress by Stephen A. Douglas in January 1854. The Act opened Kansas Territory and Nebraska Territory to slavery and future admission of slave states by allowing white male settlers[1] in those territories to determine through "popular sovereignty" whether they would allow slavery within each territory. Thus, the Kansas-Nebraska Act effectively undermined the prohibition on slavery in territory north of 36°30′ latitude which had been established by the Missouri Compromise. This change was viewed by Free Soilers and many abolitionist Northerners as an aggressive, expansionist maneuver by the slave-owning South, and led to the creation of the Republican Party.

Compromise of 1850

The _________ __ _____ was a package of five separate bills passed by the United States Congress in September 1850, which defused a four-year political confrontation between slave and free states regarding the status of territories acquired during the Mexican-American War (1846-1848). The compromise, drafted by Whig Senator Henry Clay of Kentucky and brokered by Clay and Democratic Senator Stephen Douglas, reduced sectional conflict. Controversy arose over the Fugitive Slave provision. Map of free and slave states c. 1856 The Compromise was greeted with relief, although each side disliked specific provisions. Texas surrendered its claim to New Mexico, over which it had threatened war, as well as its claims north of the Missouri Compromise Line. It retained the Texas Panhandle and the federal government took over the state's public debt. California was admitted as a free state with its current boundaries. The South prevented adoption of the Wilmot Proviso that would have outlawed slavery in the new territories[1] and the new Utah Territory and New Mexico Territory were allowed, under the principle of popular sovereignty, to decide whether to allow slavery within their borders. In practice, these lands were generally unsuited to plantation agriculture and their settlers were uninterested in slavery. The slave trade (but not slavery altogether) was banned in Washington D.C. The Compromise became possible after the sudden death of President Zachary Taylor, who, although a slaveowner, had favored excluding slavery from the Southwest. Whig leader Henry Clay designed a compromise, which failed to pass in early 1850, due to opposition by both pro-slavery southern Democrats, led by John C. Calhoun, and anti-slavery northern Whigs. Upon Clay's instruction, Democratic Senator Stephen Douglas (Illinois) then divided Clay's bill into several smaller pieces and narrowly won their passage over the opposition of those with stronger views on both sides.

Nullification Crisis

The _________ ______ was a sectional crisis during the presidency of Andrew Jackson created by South Carolina's 1832 Ordinance of Nullification. This ordinance declared by the power of the State that the federal Tariffs of 1828 and 1832 were unconstitutional and therefore null and void within the sovereign boundaries of South Carolina. The controversial and highly protective Tariff of 1828 (known to its detractors as the "Tariff of Abominations") was enacted into law during the presidency of John Quincy Adams. The tariff was opposed in the South and parts of New England. Its opponents expected that the election of Jackson as President would result in the tariff being significantly reduced.[1] The nation suffered an economic downturn throughout the 1820s, and South Carolina was particularly affected. Many South Carolina politicians blamed the change in fortunes on the national tariff policy that developed after the War of 1812 to promote American manufacturing over its European competition.[2] By 1828 South Carolina state politics increasingly organized around the tariff issue. When the Jackson administration failed to take any actions to address their concerns, the most radical faction in the state began to advocate that the state itself declare the tariff null and void within South Carolina. In Washington, an open split on the issue occurred between Jackson and Vice President John C. Calhoun, the most effective proponent of the constitutional theory of state nullification.[3]

Emancipation Proclamation

The __________ __________ was a presidential proclamation and executive order issued by President Abraham Lincoln on January 1, 1863, as a war measure during the American Civil War, directed to all of the areas in rebellion and all segments of the executive branch (including the Army and Navy) of the United States.[1] It proclaimed the freedom of slaves in the ten states that were still in rebellion,[2] excluding areas controlled by the Union and thus applying to 3 million of the 4 million slaves in the U.S. at the time. The Proclamation was based on the president's constitutional authority as commander in chief of the armed forces;[3] it was not a law passed by Congress. The Proclamation also ordered that suitable persons among those freed could be enrolled into the paid service of United States' forces, and ordered the Union Army (and all segments of the Executive branch) to "recognize and maintain the freedom of" the ex-slaves. The Proclamation did not compensate the owners, did not outlaw slavery, and did not grant citizenship to the ex-slaves (called freedmen). It made the eradication of slavery an explicit war goal, in addition to the goal of reuniting the Union.[

Cotton Kingdom

The notion of mass production of cotton in the South, and slavery with it, was dying out prior to the turn of the nineteenth century due to slow and unprofitable methods employed by the farmers. In 1793 that changed with the invention of Eli Whitney's cotton gin. The gin made mass cotton production in the South feasible and helped to institutionalize slavery in the region. The Louisiana Purchase and the annexation of Texas as a slave state helped to expand the Cotton Kingdom. Politically, cotton became the foundation of southern control of the Democratic Party. The widespread use of the cotton gin, invented by Eli Whitney in 1793, made cotton plantations efficient and profitable. The demand for cotton also grew because of the developing textile industries in the North and in Britain. Cotton plantations spread across the South, and by 1850, the southern U.S. grew more than 80 percent of the world's cotton.

Jeffersonian Republican

The term Democratic-Republican Party is the name used primarily by modern political scientists for the first "Republican Party" (as it called itself at the time), also known as the Jeffersonian Republicans. Historians usually use "Republican Party." It was the second political party in the United States, and was organized by then United States Secretary of State, Thomas Jefferson and his friend and compatriot James Madison, (then serving in the House of Representatives) in 1791-93, to oppose the Federalist Party run by Secretary of the Treasury, Alexander Hamilton.[1] The new party controlled the Presidency and Congress, and most states, from 1801 to 1825, during the First Party System. Starting about 1791 one faction in Congress, many of whom had been opposed to the new Constitution, began calling themselves Republicans in the Second United States Congress. People at the time used the name Republican in mentioning the Republican Party of this period and the first two decades of the 19th Century. The Republican Party split after the 1824 presidential election into two parties: the Democratic Party and the short-lived National Republican Party (later succeeded by the Whig Party).

Great Awakening

Nat Turner's Rebellion

___ _______ ________ (also known as the Southampton Insurrection) was a slave rebellion that took place in Southampton County, Virginia, during August 1831.[1] Led by Nat Turner, rebel slaves killed anywhere from 55 to 65 people, the highest number of fatalities caused by any slave uprising in the American South. The rebellion was put down within a few days, but Turner survived in hiding for more than two months afterwards. The rebellion was effectively suppressed at Belmont Plantation on the morning of August 23, 1831.[2] There was widespread fear in the aftermath of the rebellion, and white militias organized in retaliation against slaves. The state executed 56 slaves accused of being part of the rebellion. In the frenzy, many non-participant enslaved people were punished. At least 100 blacks, and possibly up to 200, were murdered by militias and mobs in the area. Across the South, state legislatures passed new laws prohibiting education of slaves and free blacks,[3] restricting rights of assembly and other civil rights for free blacks, and requiring white ministers to be present at black worship services.

Dred Scot v. Sanford

____ ___ v. ________, 60 U.S. 393 (1857), was a landmark decision by the U.S. Supreme Court in which the Court held that African Americans, whether enslaved or free, could not be American citizens and therefore had no standing to sue in federal court,[2][3] and that the federal government had no power to regulate slavery in the federal territories acquired after the creation of the United States. Dred Scott, an enslaved African American man who had been taken by his owners to free states and territories, attempted to sue for his freedom. In a 7-2 decision written by Chief Justice Roger B. Taney, the Court denied Scott's request. For only the second time in its history the Supreme Court ruled an Act of Congress to be unconstitutional.[4] Although Taney hoped that his ruling would settle the slavery question once and for all, the decision immediately spurred vehement dissent from anti-slavery elements in the North, especially Republicans. Most scholars today (as did many contemporary lawyers) consider the ruling regarding slavery in the territories to be dictum, not binding precedent. The decision would prove to be an indirect catalyst for the American Civil War. It was functionally superseded by the Civil Rights Act of 1866 and by the Fourteenth Amendment to the United States Constitution, which gave blacks full citizenship. As of 2007 it is widely regarded by scholars as the worst decision made by the United States Supreme Court.[3][5][6]

John Brown's Raid

____ _____ ____ on Harpers Ferry (also known as John Brown's raid or The raid on Harpers Ferry; in many books the town is called "Harper's Ferry"[1] was an attempt by the white abolitionist John Brown to start an armed slave revolt in 1859 by seizing a United States arsenal at Harpers Ferry, Virginia. Brown's raid, accompanied by 20 men in his party, was defeated by a detachment of U.S. Marines led by Col. Robert E. Lee. John Brown had originally asked Harriet Tubman and Frederick Douglass, both of whom he had met in his formative years as an abolitionist in Springfield, Massachusetts, to join him in his raid, but Tubman was prevented by illness, and Douglass declined, as he believed Brown's plan would fail.[2]

Anti-Federalism

Bacon's Rebellion

_____ _______ was an armed rebellion in 1676 by Virginia settlers led by Nathaniel Bacon against the rule of Governor William Berkeley. The colony's disorganized frontier political structure, combined with accumulating grievances (including leaving Bacon out of his inner circle, refusing to allow Bacon to be a part of his fur trade with the Native Americans, and Doeg tribe Indian attacks), helped to motivate a popular uprising against Berkeley, who had failed to address the demands of the colonists regarding their safety.

Lord Dunmore's Proclamation

_____ ________ __________, also known as Dunmore's "Emancipation Proclamation,"[1] is a historical document signed on November 7, 1775, by John Murray, 4th Earl of Dunmore, royal governor of the British Colony of Virginia. The proclamation declared martial law[2] and promised freedom for slaves of American revolutionaries who left their owners and joined the royal forces. Formally proclaimed on November 14, its publication prompted a small flood of slaves (from both patriot and loyalist owners) to run away and enlist with Dunmore, although the numbers were small compared to the state's total slave population. It also raised a furor among Virginia's slave-owning elites (again of both political persuasions), to whom the possibility of a slave rebellion was a major fear. The proclamation ultimately failed in meeting Dunmore's objectives; he was forced out of the colony in 1776, taking about 300 former slaves with him. The proclamation can be considered part of a larger trend of Great Britain fighting against slavery and racial inequality, some other examples of which are Somerset v Stewart and the Committee for the Relief of the Black Poor. In addition, the British raised several regiments of black soldiers during the American Revolution.

Shay's Rebellion

_____ ________ was an armed uprising that took place in Massachusetts (mostly in and around Springfield) during 1786 and 1787, which some historians believe "fundamentally altered the course of United States' history." [1][2] Fueled by perceived economic terrorism and growing disaffection with State and Federal governments,[1] Revolutionary War veteran Daniel Shays led a group of rebels (called Shaysites) in rising up first against Massachusetts' courts, and later in marching on the United States' Federal Armory at Springfield in an unsuccessful attempt to seize its weaponry and overthrow the government.[2] Although Shays' Rebellion met with defeat militarily, it bore fruit in forcing the Federal government to reconsider the extent of its own powers at the U.S. Constitutional Convention, and by drawing General George Washington out of retirement en route to his Presidency, among influencing other changes to America's young democracy.[1][2]

Popular Sovereignty

_______ _________ is a doctrine rooted in the belief that every human being is sovereign, and rather than a monarch or single individual, that they could unite and each delegate a small portion of their sovereign powers and duties to those who wished to temporarily serve as officers and employees of a state, who would then serve the rest of the people according to the will of the people expressed via a constitution and democratic process. That the people fought for equality with the King of England was enshrined in their Declaration of Independence and was a matter of common knowledge in America after the Revolution. The first Chief Justice, John Jay, published this in his Opinion in the first major supreme Court case in order to briefly illustrate what was ordained and established and would eventually come to be known by the American usage of the term "popular sovereignty":

Marbury v. Madison

_______ v. _______, 5 U.S. 137 (1803), was a landmark United States Supreme Court case in which the Court formed the basis for the exercise of judicial review in the United States under Article III of the Constitution. The landmark decision helped define the boundary between the constitutionally separate executive and judicial branches of the American form of government. The case resulted from a petition to the Supreme Court by William Marbury, who had been appointed Justice of the Peace in the District of Columbia by President John Adams but whose commission was not subsequently delivered. Marbury petitioned the Supreme Court to force the new Secretary of State James Madison to deliver the documents. The Court, with John Marshall as Chief Justice, found firstly that Madison's refusal to deliver the commission was both illegal and remediable. Nonetheless, the Court stopped short of compelling Madison (by writ of mandamus) to hand over Marbury's commission, instead holding that the provision of the Judiciary Act of 1789 that enabled Marbury to bring his claim to the Supreme Court was itself unconstitutional, since it purported to extend the Court's original jurisdiction beyond that which Article III established. The petition was therefore denied.

Indentured Servant

________ _______ was a labor system where by young people paid for their passage to the New World by working for an employer for a certain number of years. It was widely employed in the 18th century in the British colonies in North America and elsewhere. It was especially used as a way for poor youth in Britain and the German states to get passage to the American colonies. They would work for a fixed number of years, then be free to work on their own. The employer purchased the indenture from the sea captain who brought the youths over; he did so because he needed labour. Some worked as farmers or helpers for farm wives, some were apprenticed to craftsmen. Both sides were legally obligated to meet the terms, which were enforced by local American courts. Runaways were sought out and returned. About half of the white immigrants to the American colonies in the 17th and 18th centuries were indentured. During the late 17th and early 18th centuries poor children from England and France were kidnapped and sold into indentured labor in the Caribbean for a minimum of five years, but most times their contracts were bought and sold repeatedly and some laborers never attained their freedom

Federalism

________ is a system based upon democratic rules and institutions in which the power to govern is shared between national and provincial/state governments, creating what is often called a federation. The term federalist describes several political beliefs around the world. Also, it may refer to the concept of parties; its members or supporters called themselves Federalists.[1]on of the Constitution of 1788. The previous constitution, called the Articles of Confederation, gave state governments more authority. Led by Patrick Henry of Virginia, Anti-Federalists worried, among other things, that the position of president, then a novelty, might evolve into a monarchy. A book titled "The Anti-Federalist Papers" is a detailed explanation of American Anti-Federalist thought.

Conscription

_________ (or drafting) is the compulsory enlistment of people in some sort of national service, most often military service.[1] Conscription dates back to antiquity and continues in some countries to the present day under various names. The modern system of near-universal national conscription for young men dates to the French Revolution in the 1790s, where it became the basis of a very large and powerful military. Most European nations later copied the system in peacetime, so that men at a certain age would serve 1-8 years on active duty and then transfer to the reserve force.

Paternalism

_________ (or parentalism) is behavior, by a person, organization or state, which limits some person or group's liberty or autonomy for that person's or group's own good.[1] Paternalism can also imply that the behavior is against or regardless of the will of a person, or also that the behavior expresses an attitude of superiority.[2] The word paternalism is from the Latin pater for father, though paternalism should be distinguished from patriarchy. Some, such as John Stuart Mill, think paternalism to be appropriate towards children: "It is, perhaps, hardly necessary to say that this doctrine is meant to apply only to human beings in the maturity of their faculties. We are not speaking of children, or of young persons below the age which the law may fix as that of manhood or womanhood."[3] Paternalism towards adults is sometimes thought to treat them as if they were children.[4] Examples of paternalism include laws requiring the use of motorcycle helmets, a parent forbidding their children to engage in dangerous activities, and a psychiatrist confiscating sharp objects from someone who is suicidally depressed.
