At this point, the court will normally decide whether the counselor's information is necessary, and, if so, will provide the counselor with a court order demanding the release of the information. IF a counselor received both a subpoena and a court order, he or she must comply or be held in contempt of court. Under ACA Code of Ethics, if counselors have to share private information, they should only disclose information germane to the case and nothing more.

Privileged communication

a legal term that protects certain counselor-client communication in the court systems. In many states counselors, like doctors, are protected under privileged communication from having to reveal information about a client in a legal proceeding, even if they receive a subpoena. Both confidentiality and privileged communication belong to the client, meaning that the client can choose to waive his or her right to either, allowing the counselor to ethically and legally disclose private information about the client.

The new ACA ethical requirement to have a transfer plan in writing would apply to
