Workplace Safety and Insurance Act

This is a provincial labour legislation that ensures workers are compensated for and are able to successfully return after injuries in the workplace and occupational diseases.

Labour Law

Also called employment law, this sector of law governs the relationships and policies between unions, employers, and employees. This body of law manages 'labour relations'.

Arbitration

Arbitration is another process of introducing a third party to help two disputing parties find a resolution. However, in this process, the arbitrator (third party) hears the evidence, and decides on a settlement in which the two disputing parties do not get a say in.

Collective Bargaining

Collective Bargaining is the negotiations of wages, benefits, hours, and other working conditions between an employer and a group of employees. It is usually between the trade union and management.

Sexual Harassment in the Workplace

In the Canada Labour Code, Sexual Harassment is defined as any conduct, comment, gesture, or contact of a sexual nature likely to cause offence or humiliation or that might, on reasonable grounds, be perceived as placing a condition of a sexual nature on employment or on any opportunity for training or promotion.

Labour Relations

Labour Relations is the relationship between the employer and the employees. In Ontario, it focuses on settling labour disputes, assisting in settlements for collective bargaining, and producing other information for collective bargaining.

Mediation

Mediation is the process of bringing in a third party to intervene between two parties who are having a dispute and helping them form a settlement. In mediation, the two disputing parties have a say in the settlement.

Canada Labour Code

The Canada Labour Code is the federal labour legislation that sets labour standards such as minimum wage, hours, holidays, etc., controls occupational health and safety, and manages industrial relations (with unions) for federal employers and employees.

Employment Standards Act

The Employment Standards Act is provincial legislation that sets out the rights and responsibilities of employers and employees in Ontario. It includes components such as minimum wage, vacation pay, leaves of absences, etc.

Occupational Health and Safety Act (Ontario)

The Occupational Health and Safety Act for Ontario sets out the rights and duties in making workplaces safe and healthy for all employers, employees and persons in the workplace. For example, it manages procedures for dealing with workplace hazards, prevention of these hazards, and penalties for not complying with the health and safety standards.
