How to tell if an ID is counterfeited

1. Hold the ID in your hand and look for irregularities. Bend The ID - strongly bend the ID inward on the picture side. Make sure the finish of the ID does not crinkle or wrinkle. Make sure the lamination does not peel or become unattached. 2. Check The Edges - look for a line of dirt or debris around the lamination and edges of the ID. Counterfeiters frequently use a weak glue that collects dirt from peoples wallets and pockets. 3. Every state creates IDs with unique security features to make them difficult to duplicate or copy. Below are examples of commonly used security features. Check For Holograms - hold the ID up to the light to look for holograms. Check For Microprint - hold the ID under a magnifying glass to look for microprint. Check For Hidden Images - hold the ID under an ultraviolet light to look for hidden images.

How to tell if an ID is stolen or borrowed

1. Look closely at the photo on the ID to make sure it matches the customer's face. Compare the customer to physical descriptions on the ID that typically don't change, such as height and eye color. 2. If someone borrows or steals another person's ID, they are unlikely to have an additional form of false ID that supports the original ID they gave you. Try asking for a credit card, library card or student ID to see if it contains the same information as the presented ID. 3. Ask the customer for their signature and then compare it to the signature on the ID. 4. If someone borrows or steals another's person's ID, they may not have the information on the ID memorized. Ask the customer questions about the ID. The way the customer answers your questions can give you a clue as to whether or not they being truthful. Ask for their birthday. Ask for their full address. Ask for the year they graduated high school.

Liquor Licensee

A liquor licensee is any person or legal entity granted the privilege of selling alcoholic beverages. Liquor licensees must take alcohol server education if they hold a license that allows the sale and service of alcohol for on-premises consumption. Licensees must also verify the age and identity of the person who shows the permit.

Separate alcohol

A liquor licensee, its employees and its customers must not have any alcoholic beverages on the licensed premises that its license does not allow it to sell or serve. For example, a restaurant with a Limited On-Premises Sales liquor license is only permitted to sell beer and wine so it could not allow a customer to bring hard liquor onto the premises. On the other hand, the same restaurant could allow a customer to bring a bottle of wine onto the premises because it is allowed to sell that type of alcohol.

Spouses

A minor may be allowed in areas prohibited to minors if he or she is in the immediate company or his or her spouse or domestic partner who is at least 21 years old. The minor is still not allowed to purchase, possess or drink alcohol. However, it is common and acceptable for establishments to have a house policy preventing minor spouses from entering areas prohibited to minors.

BAC is the legal standard the courts and law enforcement use to measure a person's level of intoxication. The most reliable method for determining BAC is with a chemical analysis of the blood, however, breath and urine tests can also be used.

BAC increases when alcohol is consumed quicker than the body can process it. You will see that there are many factors that can affect how quickly the body processes alcohol, but ultimately TIME is the only factor that reduces BAC and intoxication.

Intervention attitudes : professional

Be tactful - Never accuse a customer of being intoxicated. Be courteous - people are more cooperative if they feel they are being respected. Be discreet - Make every effort not to emberass the customer. Be confident - Confidence convinces people you are doing the right thing. Be firm - do not allow an impaired customer to talk you out of your decision.

Aspirin

Because mixing alcohol with other drugs can be dangerous, servers are not permitted to give away or sell aspirin or any other non-prescription drug to patrons in licensed premises.

Boating under the influence

Boating Under The Influence of Intoxicants (BUII) is a Class A Misdemeanor and the laws and penalties associated with it are similar to those of driving under the influence. In Oregon, a boater is considered legally "under the influence" if the boater's BAC is 0.08% or higher. By operating a boat on Oregon waters, you give implied consent to submit to field sobriety and BAC tests. Lastly, an individual convicted of a BUII is subject to fines, jail time and loss of boat operation privileges.

Alcohol and stimulants

Alcohol and stimulants have opposite effects on the central nervous system. When used together, they cause serious imbalances to the body. Adderall, cocaine, methamphetamine and other stimulants can mask the side effects of alcohol. This can cause a person with a high BAC to not feel intoxicated and to continue drinking to dangerous levels.

Alcohol and depressants

Alcohol dangerously increases the effects of sedatives, pain killers, opiates, benzodiazepines and other depressant drugs. For example, mixing alcohol with another depressant can increase the depressant's effects by five times! While this worsens impairment and the ability to drive safely, it also can result in life-threatening slowing of vital functions.

Alcohol and sexual assault

Alcohol is the most common drug associated with sexual assault. As we have learned, it alters judgment, lessens inhibitions, and impairs vision, speech and coordination. Alcohol can therefore make a person vulnerable, dependent and easily manipulated. Various studies have concluded that over 50% of those who commit rape and over 50% of those who are raped were under the influence of alcohol at the time of the rape.¹

Alcohol and other drugs

Alcohol should not be used with other drugs, legal or illegal. Using alcohol with other drugs can be very dangerous to a person's health and safety. When combined, the effects of both the alcohol and the other drug can be exacerbated or have unintended side effects.

Food consumption

Alcohol will affect you quickly if you drink on an empty stomach. Consuming food with alcohol is beneficial because food can slow the absorption of alcohol into the bloodstream.

Alcoholism

Alcoholism, or alcohol addiction, is a chronic, progressive disease characterized by a lack of control over drinking, preoccupation with alcohol, use despite adverse consequences and denial.

Incident log

An incident log is a written record of any event such as refusing service to a minor or intoxicated person, confiscating ID and calling the police. The log provides documentation to help build a defense in the event a lawsuit is filed. Information regarding the location, time and date. ② Description of the customer involved in the incident. ③ Circumstances of the incident in detail. ④ Description of the intervention strategies used. ⑤ Contact information for any employee who witnessed the event and can attest to the details in the log. ⑥ Contact information for any customer who witnessed the event and can attest to the details in the log. ⑦ Information regarding the vehicle, if a visibly intoxicated customer made an effort to drive. ⑧ Information of who is reporting the incident.

How to determine if someone is visibly intoxicated

Appearance - bloodshot, glassy, or watery eyes. Flushed face. Speech - thick or loud voice, speaking loud and then quiet, rambling train of thought, speaking very fast or very slow, irrational statements. Attitude - annoying, argumentative, aggressive, obnoxious, inappropriate. Behavior - careless with money, difficulty lighting cigarettes, cant find glass with mouth, lack of focus and eye contact. Other - odor of alc/weed, sweaty af, repeated trips to bathroom or outside.

Step 2 evaluating VIPs - count standard drinks consumed

Determine how much alcohol the customer has consumed on the premises by counting standard drinks. Remember, 12 ounces of 5% ABV beer, 5 ounces of 12% ABV wine and 1.5 ounces of 80 proof distilled spirits equal one standard drink. In most establishments, a glass can contain more than one standard drink. Instead of counting how many glasses the customer has been served, count how many standard drinks the customer has consumed.

Alcohol Equivalency

Drink equivalency is an important concept to understand in order to serve alcohol responsibly. It means there is about the same amount of alcohol in a 12-ounce bottle of 5% ABV beer, a 5-ounce glass of 12% ABV wine and 1½ ounces of 80 proof liquor (or a mixed drink containing 1½ ounces of 80 proof liquor).

Rate of consumption

In a healthy person, the liver can metabolize one drink per hour. Consequently, a person that drinks four drinks over the course of four hours will have a much lower BAC than a person that drinks four drinks within an hour.

Body type

In general, people who are smaller and weigh less will feel the effects of alcohol quicker because they have less blood to absorb and dilute the alcohol. That said, muscle and body fat have different properties. Muscle tissue contains more blood than fat tissue and blood dilutes alcohol. As a result, if two people of the same weight drink the same amount of alcohol, the person with the higher body fat percentage should have a higher BAC.

Minor employees with service permit

Minor employees may be allowed in areas prohibited to minors only to clean up, seat patrons, restock supplies, set and clear tables and deliver food (but not take food orders). Additionally, they are permitted to enter areas prohibited to minors to order and pick-up drinks for service in non-prohibited areas.

Once servers identify a visibly intoxicated person, there are three laws they must uphold. The first law states it is illegal to serve alcohol to a visibly intoxicated person. Second, it is illegal to allow a visibly intoxicated person to consume alcohol and third, servers must make a Good Faith Effort to remove alcohol from a visibly intoxicated person. Visible intoxication is also the legal standard servers must use to decide if a customer is intoxicated. Generally, the first function alcohol impairs is judgement.

Designated Driver Program

One of the most successful methods of preventing drunk driving is by designating a person to be the driver. A designated driver is a person who agrees to not drink alcohol so that they can safely drive their friends or family home.

Mental and physical illness

Physical illness can contribute to the body being dehydrated and affect a person's overall BAC when drinking. Mental feelings of stress, anxiety, depression or anger can affect the body's enzyme production and how it is able to process alcohol. Additionally, physical and mental sickness may require the use of medications that can impact how the body reacts to alcohol.

Entertainers

Professional musicians, performers and disc jockeys may be allowed in areas prohibited to minors as long as they are actively engaged in the course of their employment. When not performing, the minor entertainer must stay in an area where minors are permitted. If there is no break room, dressing room or patron area where minors are allowed, the licensee may, with prior OLCC approval, designate a space for minor entertainers. If minor entertainers are in a designated space, no alcohol is allowed in that space even if some of the other entertainers are 21 or older.

Step 3 evaluating VIPs - Estimate BAC

Using a count of standard drinks and a BAC chart, you can make a quick estimation of a customer's BAC. Begin by comparing the customer's height and weight to your own to help you guess how much the customer weighs. Using the chart, find where the number of standard drinks and weight intersect. Adjust for time spent drinking. In Oregon, a person is legally intoxicated if they have a BAC of 0.08% or higher.

Factors that affect BAC

Alternative forms of ID: must show both

- Descriptive: must be "official" and include the persons name, address, date of birth, signature and photo or physical description. Examples include a federal employee ID card, a resident alien card, and a college student body card. - Supportive: must further prove the persons identity; can include a credit card, personalized checks or mail.

Other drugs may also be used in conjunction with alcohol in order to facilitate sexual assault. Consequently, it is a felony criminal offense to put an intoxicating substance into the food or beverage of another person without the person's consent (ORS 475.908). These substances, often referred to as date-rape drugs, may include:

- GHB: GHB, or gamma hydroxyl butyrate (also known as "G", "liquid X", "salt water" or "scoop"), causes quick sedation. Its side effects include drowsiness, nausea, vomiting, headaches, dizziness, coma and death. The drug's most common form is a clear liquid, but it can also be a white, grainy powder. - Ketamine: Ketamine (also known as "K", "Special K" or "Vitamin K") is an anesthetic commonly used by veterinarians on large animals. In humans, it can cause delirium, amnesia, impaired motor function, slurred speech and breathing problems. Its most common form is a clear liquid, but it can also be dried into an off-white powder. - Rohypnol: Rohypnol (also known by many other names including "roofies", "roopies", "circles" or "the forget pills") is a powerful tranquilizer. It causes muscle weakness, fatigue, slurred speech, loss of motor coordination and judgment, and amnesia that lasts up to 24 hours. The drug looks like an aspirin and is colorless and flavorless. When dissolved in a drink, it can take effect in as little as 20 minutes.

Types of false ID

1. Borrowed / stolen ID - a valid ID based on someone else's identity. 2. Counterfeit ID - a fake ID illegally created by a counterfeiter. 3. Altered ID - A valid ID that has been altered.

How to tell if an ID has been tampered with

1. Compare the ID to your own 2. Hold the ID in your hand and look for irregularities. Feel The ID - make sure the surface is smooth. The ID should not have any raised edges around the photograph. Feel the thickness of the ID. Tilt The ID - examine the glare off the surface of the ID. Look for dull or shiny spots. Check for changes in coloration. 3. Last but not least, evaluating body language can almost always help you determine if a minor has just illegally provided you with a false ID. Look for signs of anxiety. Does the customer avoid eye contact or appear nervous?

How to Check IDs

1. Hold the ID in your hand - have them take it out of wallet if its in a clear pocket. 2. Be sure you can read the ID - dont accept an ID that is unreadable. 3. Check the expiration date - An ID is not valid if it is expired. 4. Check the date of birth 5. verify the photo matches

Third party liability

A third party liability lawsuit involves three parties wherein the third party sues the first party for negligence. A third party liability lawsuit with regard to alcohol typically includes the following: 1st party - The server 2nd party - The intoxicated person 3rd party - The victim In Oregon, if a server (1st party) sells or gives alcohol illegally to a minor or to a visibly intoxicated person (2nd party) and that minor or visibly intoxicated person causes damages to an innocent victim (3rd party), the victim can sue the server for damages. liability only applies when the law is broken.

Ultraviolet images

By holding an Oregon ID under a blacklight or ultraviolet light you can reveal the word Oregon on the front of the card and the picture of the Oregon State Seal on the back of the card.

Implied Consent

By operating a motor vehicle within the State of Oregon, a person gives implied consent to field sobriety and BAC tests if arrested for DUII. Upon arrest, officers are required to notify drivers that they have the right to refuse to take a test to determine their BAC. When drivers refuse to take the test, they can lose their license for one year and face fines and other DUII penalties. If drivers comply with the test and their BAC is above the legal limit, they will lose their license for a minimum of 90 days and face fines and other DUII penalties.

Holographic images

By twisting and turning an Oregon ID under the light, several holographic images appear. The word "Oregon" is in the upper left-hand corner, the state flag is in the lower left-hand corner and a western meadowlark bird can be seen in the lower right-hand corner. Additionally, the outline of the State of Oregon and the names of its counties can be seen behind the western meadowlark. In the lower quarter of the card, the Oregon State Motto is repeated in both latin, "alis volat propriis," and English, "she flies with her own wings."

Security features 2007-2019

Cards issued to adults feature a high-definition photo on the left side of the card (see top example). Cards issued to minors include a red border around the photo with dates the card holder will turn 21 years old and 18 years old. The date the card holder will turn 18 only appears if the card was issued prior to the card holder's 18th birthday. The photo is on the right side of the card instead of the left (see bottom example). The State of Oregon seal overlaps the card holder's photo. A small "ghost image" of the photo has text overlapping it. An image of the state capitol building appears behind the text portion of the card. Holographic laminate contains the word "OREGON" repeated diagonally in three colors across the upper part of the card. A rainbow-gradient color bar goes down the side of the card. Color changes from blue to red to yellow. The reverse of the card includes a one dimensional barcode that includes the license number and date of birth in addition to a two dimensional barcode that includes all the information on the face of the card except for the photo and signature.

Security features 2019-2020

Cards issued to adults feature a horizontal layout (see top example). Cards issued to minors feature a vertical layout. "UNDER 21 UNTIL MM-DD-YYYY" is printed within a wide red border on the right side of the card. If the person is under 18 when issued, the card will also have "UNDER 18 UNTIL MM-DD-YYYY" text (see bottom example). The card body is a durable, tamper-resistant plastic material made of a polycarbonate blend. All retail licensees are required by law to post signs warning patrons of the risks of alcohol consumption by pregnant women. Despite the danger involved, it is not illegal for a pregnant woman to consume alcohol. As a server, you should be aware that it may violate anti-discrimination laws to refuse service based on pregnancy.

Hours of service

In Oregon, the legal hours to sell, serve or consume alcohol are from 7:00 AM to 2:30 AM. As an employee, you may be entitled to a "shift drink." If this is the case, you must drink it after 7:00 AM and before 2:30 AM, but not while you are on duty, on a break or about to go on duty.

Legal drinking age

In Oregon, there are only two exceptions to the law. ① Parents or guardians may provide alcohol to their own minor children in a private residence. ② Minors may drink sacramental wine in a religious ceremony. You still cannot allow parents or guardians to give alcohol to a minor on the premises.

Microprint

Hold the ID under a magnifying glass to check for microprint. To the naked eye, microprint will look like a straight or wavy line. Under a magnifying glass, microprint will be a series of letters or words. While many counterfeiters can replicate holograms and UV features, they often cannot replicate microprint.

Service permits are valid for five years from their date of issue by the OLCC.

How Long Are Service Permits Valid

Alcohol is produced through the fermentation and distillation of grain, starch, molasses or sugar. The breakdown of carbohydrates results in ethyl alcohol, more commonly known as ethanol. Ethanol is the type of alcohol that is present in beer, wine and hard liquor.

Gender

If a woman and a man of the same weight drink the same amount of alcohol, the woman will generally have a higher BAC. This is because women produce fewer of the liver enzymes that are responsible for the breakdown of alcohol. Additionally, women tend to have a lower percent of muscle tissue than men, and thus, less blood to dilute the alcohol.

Vendors or contractors

Individuals who have a legitimate business purpose (such as plumbers, electricians or janitors) may be allowed in areas prohibited to minors as long as they are actively engaged in the course of their employment.

It is illegal to serve to them. It is illegal to allow them to consume further alcohol. Good faith requires you to take the drink or ask for the drink.

Serving alcoholics

It is important for servers to understand the concept of tolerance because a person with a high tolerance may be legally drunk long before they exhibit visible signs of intoxication. Even if you know a customer is suffering from alcoholism, you are still allowed to serve the customer alcohol, provided they are not showing signs of visible intoxication. However, because many of the visible signs of intoxication may be suppressed by high tolerance, you may want to put more emphasis on counting drinks and using the BAC chart to help you decide whether or not to continue serving.

Proof of alcohol

Proof is a measure of the content of ethanol in an alcoholic beverage. The higher the proof, the higher your BAC and the longer it will take your body to process the alcohol. For example, it will take your body an hour to process a typical shot (1.5 oz) of 80 proof hard liquor, but it will take your body almost two hours to process a shot of 151 proof Bacardi and almost two and a half hours to process a shot of 190 proof Everclear.

Sex traffickers are commonly linked to areas of the hospitality industry, such as bars and clubs. For this reason, service permit holders are required to make a report to law enforcement and the OLCC if they suspect sex trafficking is occurring at the licensed premises (Senate Bill 515). Similarly, they are also required to make a report if they suspect a minor is working at the establishment in a manner that violates commission rules (e.g., stripper, exotic dancer).

Step 4 evaluating VIPs - Look for visible signs of intoxication

The standard you are held to in identifying intoxicated customers is visible intoxication. While you do not need to memorize all 50 signs of intoxication, it is important to know intoxication can be visible in a person's appearance, speech, attitude and behavior. Be sure to constantly check in with your customers and engage with them so that you can identify if they are beginning to show signs of intoxication.

Step 1 evaluating VIPs - establishing a baseline

When a customer arrives at your establishment, evaluate the customer's demeanor. Use the customer's initial demeanor as a baseline to compare to their current demeanor. This baseline will help you identify changes to the customer's appearance, speech, attitude and/or behavior.

Tasting on duty

While on duty, an adult permittee may be allowed to taste beer (malt beverages), wine or cider if all of the following conditions are met: ① The licensee/owner allows it. ② Servings are one ounce or less and not more than 6 ounces total in any given day. ③ Tasting is for educational purposes or to ensure product is not flawed. ④ The alcohol is tasted between 7:00 AM and 2:30 AM.

Fact

a liquors proof is equal to 2x its alcohol by volume (ABV) percentage. For example, an 80 proof liquor has an abv of 40%.

Blood Alcohol Concentration (BAC)

a measurement of the amount of alcohol in the bloodstream and is expressed as a percentage of alcohol in relation to blood components. For example, a .08% BAC means there are eight parts of alcohol per 10,000 parts of blood.

Estimating BAC

① An individual's weight; and ② How many standard alcoholic drinks the individual has consumed. Once you have both pieces of information, find the intersection of the individual's weight and the number of drinks they have consumed on the chart. This will give you their estimated BAC.

① Primarily through the body's detoxification organ, the liver. ② Through the lungs (exhaled from the body). ③ Through the kidneys (removed through the body's urine). ④ Through the sweat glands (removed through perspiration).
