Exclusionary Rule
A pat down of person's exterior clothing to check for weapons. Only purpose of a this definition is to protect the officer. Can go beyond exterior of clothing if unable to determine in good faith if a weapon is present after patting down exterior clothing.
Frisk
that which is not concealed or hidden and out for anyone to see; Officer is not in a position where he can legally immediately seize the evidence ("outside looking in")
Open view
object must be immediately identifiable as weapon/contraband without further manipulation or intrusion by officer than what is required for frisk
Plain feel
which is visible from where an officer has a legal right to be, and the officer may immediately seize the item. The officer must be legally present and the seized item must be immediately recognizable as being crime related (evidence or contraband); need not be inadvertent
Plain view
Suspect may withdraw consent at any time and search must stop is called
Revocation of consent
An exercise of dominion or control of that person or object.
