Question Workspace You are the director of health information services at a tertiary-care hospital. You and the director of emergency room services are jointly responsible for reporting instances of communicable disease, child abuse, and cancer to the appropriate state authority. You have just completed an audit of your institution's reporting mechanism and discovered that the reporting requirements are not consistently met. The audit could not definitively establish whether the reporting never occurred or occurred but was not documented in the patient's health record. Discuss what legal issues are present and what approaches you should take to resolve this problem.
The legal issue present is that reporting is mandatory and if the audit can't establish whether a report occurred, then there's a possibility the reports were not made at all, which could be an infraction of the law. I would hold a meeting with the director of emergency room services immediately to address each occurrence on the audit where it is unclear whether a report was made and ensure that proper procedures were followed. If they were not, we will immediately file the reports that were missed. Then, we will sit down and make a plan to ensure all reports are filed. We will plan for training and a checklist and make sure each employee is aware of the importance of filing mandatory disclosures.
