Penalties - Failure to Comply

Confidentiality Safeguards
- Avoid discussing patients in public areas. - Use a low voice when communicating if there is a risk of being overheard. - Use only the patient's name on sign-in lists. - Locate printers/fax machines in secure areas. - Verify the receiver of any data you transmit. - Shred old documents containing PHI.
Allowable Disclosures
- Disclosures to a healthcare provider for treatment purposes - Disclosure made to a parent of their child's medical record if child is a minor - Disclosures made to individual who is the subject of information - Disclosure made pursuant to an individual's authorization
