Section I of HO Policy provides coverage for all the following EXCEPT: A. Dwelling and personal property, B. Theft, C. Medical Payments, or D. Loss of Use.

HO Section II Conditions that Apply --Limit of Liability

The Coverage E limit is the most the insurer will pay for all bodily injury and property damage resulting from any one occurrence, regardless of the number of insureds, claims made or persons injured. The Coverage F limit is the most that will be paid for all medical expenses payable for bodily injury to one person as a result of one accident.

Conditions that Apply to HO Section I and II and DP Forms-Concealment or Fraud

The entire policy is void if, before or after a loss, the insured intentionally concealed or misrepresented a material fact or circumstance or engaged in fraudulent conduct relating to the insurance .

HO Section II-Additional Coverages-That DOES NOT Apply-Loss Assessment

The insurer will pay up to $1000 per occurrence or act, when a homeowner's association assesses the named insured for his share of a loss due to bodily injury or property damage not excluded under Section II; or liability for an act of an elected unpaid director, officer or trustee of the association.

Conditions that Apply to HO Section I and II and DP Forms-Policy Period

The loss must occur during the policy period for coverage to apply. This times and dates of policy inception and expiration are noted in the declarations. A loss occurring during the policy period is covered even if the claim is made after the policy expires.

Residence Premises is:

The one-family dwelling, where the named insured resides, the two, three, or four family dwelling where the named insured resides in at least one of the units; or the part of any other building where the named insured resides.

Conditions that Apply to HO Section I and II and DP Forms-Assignment

The policy can be assigned only with the written consent of the insurer.

Conditions that Apply to HO Section I and II and DP Forms-Cancellation and Nonrenewal

The policy has cancellation and non-renewal that clauses that comply with state requirements...see the Code sections for any applicable requirements.

Liability Endorsements-Limited Fungi, Wet or Dry Rot, or Bacteria Coverage...

These endorsements restrict coverage for losses caused by these perils by adding mold to the definition of fungi, changing the mold exclusion to cover only mold that results from fighting a fire, restricting coverage for repeated seepage so that coverage will only apply when the repeated seepage and resulting damage occurred without the knowledge of any insured. They also limit coverage to $10,000 for loss from mold arising from a covered water loss, with an annual aggregate limit of $50,000 placed on mold liability claims. Both limits can be increased if the insured chooses.

HO Section II-Additional Coverages that DOES NOT Apply:

This coverage does not apply to the amount recoverable for the same damage under Section I; or to damage caused intentionally by an insured 13 or older; or to property owned by an insured; or to property owned by or rented to a tenant of an insured or a resident of the household; or arising out of a business engaged in by the insured; or an act or omission in connection with premises an insured owns, rents or controls, other than an insured location; ownership, maintenance, or use of aircraft, watercraft or motor vehicles or other motorized land conveyances except one designed for recreational use off public roads, not subject to motor vehicle registration and not owned by an insured.

HO Section II-Additional Coverages-First Aid Expense

This covers an insured's expenses in providing first aid to others but not to any insured, for bodily injury covered under the policy. For example, When Bog had a barbecue in his backyard, a guest slipped on the steps to his deck and suffered a concussion. Bob voluntarily paid for first aid, ambulance and related expenses. This expense was covered by his HO policy.

Liability Endorsements-Permitted Incidental Occupancies

This deletes the HO business activities exclusions for a special office, studio, or school operation using less than half of the dwelling area. It also allows coverage of an "other structure" on the residence premises used in business to be scheduled with a specified limit of liability. It removes the $2500 limit for business property on the residence premises., so full Coverage C will apply to furnishing, supplies, and equipment used in the business. It adds Section II liability and medical payments coverage for the necessary or incidental use of the premises to conduct the described business, but not for acts or omissions involving any service or duty to be provided because of the nature of the business. For example, Bob decided to make his hobby of taking portraits was something he wanted to do on a part-time basis. Bob called his insurance agent to have him endorse their HO policy to add an "Incidental Occupancies Endorsement" for a photo studio that he was adding to his home.

Liability of Endorsements-Watercraft

This eliminates the HO liability exclusions for watercraft, to provide coverage for liability pertaining to ownership, maintenance, or use of scheduled watercraft with inboard-out drive power; or watercraft with outboard motors in excess of 25 total HP, or sailing vessels 26' or longer.

Home Daycare-HO 04 97

This endorsement deletes the HO policy business exclusions to provide property and liability coverage for a home daycare business operated on the residence premises, with regard to property insurance it; adds property insurance under Coverage B-other structures if a detached structure is used for a daycare business. Without this endorsement Coverage B does not apply, increases the coverage limit for a premise's business furnishing and equipment, which in the HO policy is $2,500, to the full Coverage C limit.

HO Section II Conditions that Apply --Serverability of Insurance

This insurance applies separately to each insured, but this will not increase the limit of liability for any one occurrence. For example, If Bob and Bobby had a policy limit of $200K the maximum amount payable under the policy would be $200K, not the $400K ($200K for Bob and $200K for Bobby)

HO Section II-Additional Coverages-Claims Expense

This provides coverage in suit defending by the insurer, for expenses the insurer incurs and costs taxed against an insured; Premiums on required bonds but not for bond amounts more than the Coverage E limit of Liability; Reasonable expenses incurred by an insured at the insurer's request, including actual loss or earnings up to $50 per day, for assisting in investigation or defense of the claim or suit; interest charged on a judgement before it is paid by the insurer.

Liability of Endorsements-Incidental Farming Personal Liability

This provides personal liability and medical payment coverages for incidental farming operations on the residence premises, if such operations are not the insured's business or principal occupation.

Liability of Endorsements-Additional Residence Rented to Others

This provides personal liability and medical payments coverage for a homeowner's liability arising out of ownership of residence regularly rented to other. It adds the premises listed in the endorsement as an "insured location."

HO Section II-Additional Coverages-Damage to Property of Others

This provides replacement cost coverage of up to $1000 per occurrence for damage to property of others caused by an insured. This is a no-fault coverage that applies even if the insured is no proven to be at fault. When the loss is also recoverable under Section I of the policy, this coverage applies on an excess basis. Under Section I, the named insured can request the policy also cover personal property owned by others, while it is on the part of the premises occupied by an insured, and/or property owned by a guest or residence employee while it is in any residence occupied by an insured. When he requests this coverage, the property of others would be covered under Section I and not under this Section II coverage. However, up to $1000 of any part of the loss not recoverable because of the Section I deductible would be recoverable under this coverage.

Conditions that Apply to HO Section I and II and DP Forms-Waiver or change of policy provisions

Waiver and changes of any policy provision are valid if in writing by the insurer. A request for an appraisal or examination does not create a waiver of the insurer's right to deny coverage,

HO Section II--Liability Exclusions continued

Watercraft excluded are those that are designed to be propelled by engine power or electric motor, or are sailing vessels, whether owned by or rented to an insured. They would be covered if they are stored including those not meeting the specifications below; powered by inboard or inboard-outdrive motor power of 50 HP or less and not owned by an insured; or more than 50 horsepower and not owned or rented to an insured. Powered by one or more outboard motors with 25 total HP or less; more than 25 HP if the outboard motor is not owned by an insured; or more than 25 total HP owned by an insured if the named acquires them during the policy period; or prior to the policy period and declares them at policy inception or reports an intention to insure to the insurer in writing within 45 days after he acquires them. Sailing vessels, with or without auxiliary power, either less than 26' or 26' more in length not owned by or rented to an insured.

Home Daycare-HO 04 97 continued

With regard to liability coverage the endorsement provides liability and medical payments coverage for such a business under an aggregate limit of liability, coverage excludes; injury to a nonresident employee of the daycare, corporal punishment, sexual abuse, maintenance, use or entrustment by the insured to others of draft or saddle animals, aircraft, motorized land conveyances and watercraft when used for instructional purposes. Coverage is subject to a policy year aggregate limit for liability and medical payments coverage equal to the Coverage E limit per occurrence. Medical Payment Losses are subject to the HO policy per-person medical payment limit. Rating is based on the number of persons receiving day care services as listed on the endorsement.

HO Section II Liability Exclusions Motorized Vehicles NOT Excluded ARE:

a trailer not towed by or carried on a motorized land conveyance; a motorized golf cart when used to play golf on a golf course, a vehicle or conveyance not subject to motor vehicle registration used sole to service an insured's residence; designed for assisting the handicapped; in dead storage on the insured location; or designed for recreational purposes off public roads, and either not owned by an insured or owned by an insured and on an insured location. The exclusions relating to uninsured locations and watercraft, aircraft and motor vehicles do not apply to bodily injury to a residence employee arising out of and in the course of the residence employee's employment by an insured.

An Occurrence is defined as...

an accident, including continuous or repeated exposure to substantially the same general harmful conditions, that results, during the policy period, in bodily injury or property damage.

HO Section II-- Liability Exclusions Neither Coverage F no Coverage E cover bodily injury or property damage that

arises out of the insured's rental or holding for rental any part of any premises, except an insured location; occasionally rented for use as a residence; rented in part for use only as residence by the occupying family and lodging no more than two roomers or boarders; or rented in part as an office, school, studio or private garage. Furthermore, excluded from these coverages are any occurrence arising out of liability for certain watercraft, aircraft and motor vehicles and other motorized land conveyances, due to ownership, maintenance, use, loading or unloading of them, including their trailers, owned or operated by a tented or loaned to an insured; an insured's entrustment of them to any person; or vicarious liability for the actions of a child or minor using any of these.

HO Section II--Liability Exclusion for as Neither Coverage E nor Coverage F cover bodily injury or property damage:

caused by war or military action, expected or intended by an insured, arising out of the transmission of a communicable disease by an insured; sexual molestation, corporal punishment, or physical or mental abuse; the use, sale, manufacture, delivery, transfer or possession of controlled substance except use of prescription drugs by a person following the orders of a licensed physician; business pursuits by an insured; premises that is not an insured location, owned by, rented to, or rented to others by an insured; or rendering or failing to render professional services.

Coverage F "GUEST MEDICAL" is defined as

coverage for guests that sustain an injury, not to a named insured or regular residents of the household, except residence employees. Residence employees are employees of the insured whose duties are related to the maintenance or use of the residence premises, such as domestic employee, or who perform similar duties elsewhere not related to an insured's business this includes his trade, profession or occupation.

Coverage E--Property Damage

is physical injury to destruction of, or the loss of use of tangible property.

HO Section II--Liability Coverages

is the same in all HO policies. It provides comprehensive personal liability insurance through: Coverage E (personal liability) Coverage F (medical payments to others) Additional Coverages

Coverage E Personal Liability--Occurrences are generally covered if they arise:

out of non-business activities of the named insured, resident family members and resident minors under 21 anywhere; or from an insured location, defined as; any part of the premises used as the named insured's residence shown in the declarations or later acquired for use as a residence; vacant land other than farm land, owned by or rented to an insured, or land on which a dwelling is being built for the insured; any part of a premises no owned by an insured where an insured is temporarily residing; or occasionally rented to an insured for other than business e.g. a hotel room or wedding hall, or cemetery plots or burial vaults.

Coverage E--Bodily Injury

refers to any bodily harm, sickness or disease, including required care, loss of services and the death that results.

HO Section II Conditions that Apply --Duties After Loss Under coverage for Damage to Property of Others,

submit within 60 days after the loss, a sworn statement of loss and show any damaged property in his control; except at his own cost, not voluntarily make any payment, assume any obligation or incur any expense other than for first aid to others at the time of the incident.

Coverage E also provides...

that the insurer may investigate, settle and/or defend at its expense by counsel of its choice any claim or suit, until the amount the pay for damages equal the coverage limit. The insurer does not have to pay to defend a suit after it has paid out the limit of its liability. This defense coverage is in addition to the coverage limit.

An insured is defined or includes:

the named insured and residents of the household who are either the named insured's relatives, or under the age of 21 and the care of the named insured or a resident relative e.g. a foster child or ward.

HO Section II--Liability Exclusions for Coverage F which DOES NOT apply to bodily injury...

to a person regularly residing on the insured location, other than a residence employee of an insured; to a residence employee if the bodily injury occurs off the insured location and does not arise out of or in the course of employment by an insured, to a person eligible for WC or similar benefits, and from any nuclear hazard.

Coverage E

will pay up to its single limit of liability (Generally $100,000) per covered occurrence for damages because of bodily injury or property damage, including prejudgment interest, for which an insured is legally liable such as bodily injury and Property Damage.

A HO Policy will cover damage to the property of others caused intentionally by an insured who is less than: A. 10, B. 13, C. 16, or D. 18

Coverage E of the HO policy provides personal liability coverage for relative residing in the named insured's household, as well as for person in the care of a resident relative up to age 18, 19, 21, or 25.

HO policy medical payments coverage will pay for injury to: A. the named insured; B. A person on the insured location without the insured's permission, C. A temporary guest or a residence employee of the insured; or D. Any person, other than a residence employee, regularly residing on the insured premises.

A temporary guest or residence employee of the insured: Medical payments is often called quest medical as it covers injury to persons invited on the premises. It does not cover the insureds' or other persons living on the premises (except for a residence employee). It does not cover any person on the premises without the insured's permission.

HO personal liability coverage will apply to: A. Liability under a written contract relating to the use of an insured location. B. Damage to property owned by the insured. C. Damage to property rented to, occupied or used by, or in the care of the insured unless the damage was caused by other than fire, smoke, or explosion. D. Liability arising out of premises, owned by, rented to, or rented to others by an insured, when the premises are not an insured location.

A. Liability under a written contract relating to the use of an insured location. While liability coverage does not apply to liability created by contracts or agreements, it does apply to written contracts that directly relate to ownership, maintenance or use of the insured location e.g. lease, easement etc... For example when a homeowner rents his garage to a third party for use as a garage. The coverage does not apply to damage to property owned by an insured, or to damage to property rented to, occupied or used by, or in the care of the insured except for damage caused by fire, smoke or explosion.

The HO personal injury endorsement applies to: A. Libel and slander. B. Contractual Liability. C. Injury arising out of the insured's business pursuits. D. Criminal activity committed with the insured's knowledge.

A. Libel and Slander.

Section II of an HO policy Covers: A, first aid expense, B, property damage arising out of a business engaged in by an insured, C, bodily injury arising out of premises that is not an insured location, or D, rented to an insured, bodily injury arising out of use of aircraft.

A; First Aid Expesnes, Coverages E and F exclude bodily injury and property, 1 expected or intended by the insured, 2 arising out of business engaged in by an insured, 3 arising out of premises rented to an insured, that is not an insured location, and 4 arising out of aircraft, motor vehicles, or watercraft, or 5 arsing from war perils. HO Section II Conditions that Apply --Duties After Loss; Duties of an Injured Person-Coverage F-Medical Payments to Others...

An injured person or someone acting for him has a duty to cooperate with the insurer by giving the insurer written proof of the claim, under oath if required, as soon as practical, and authorizing the insurer to get copies of medical reports and records; and by submitting to a physical exam by a doctor of the insurer's choice when as as often as the insurer reasonably requires.

Conditions that Apply to HO Section I and II and DP Forms-Subrogation

An insured may waive rights of recovery against a person only if it is in writing and before a loss. If those rights are not waived, the insured can be required to assign them to the insurer up to the amount he was paid by the insurer, and sign deliver all related and cooperate fully with the insurer.

HO Section II Conditions that Apply --Duties After Loss

An insured must perform and the named insured must see that the insured performs the following duties after an accident or occurrence, which are give the insurer or its agent written notice of the details of the incident as soon as practical; Promptly forward all legal papers relating to the incident; At the insurer's request help to make settlement; to enforce any right of contribution or indemnity against any person or organization who may be liable to an insured, with the conduct of suits and attend hearings and trials; and to secure and give evidence and obtain the attendance of witnesses.

Conditions that Apply to HO Section I and II and DP Forms-Liberalizaiton

Any change in the same edition of the policy that broadens coverage at no additional cost, within the 60 days before the policy period, automatically applies to this policy.

For liability coverage, an insured is also...

Any individual or organization legally responsible for the insured's watercraft or animals while they are using them with the insured's consent and not for business; and any person using a vehicle to which the policy's liability coverage applies e.g a riding lawnmower not requiring a license, either while in an insured's employ or no the insured location with the named insured's consent.

Coverage F Medical Payments to Others

This coverage applies regardless of whether the insured is at fault or has any liability.

Liability of Endorsements-Personal Injury

HO liability coverage does not apply to personal injury. This endorsement modifies the "bodily injury" definition to include "personal injury" e.g. injury arising out of false arrest, detention or imprisonment; malicious prosecution; libel, slander or defamation of character; invasion of privacy; wrongful eviction or wrongful entry...It does not apply to contractual liability, liability assumed by the insured under a contract agreement, except for an indemnity obligation assumed under a written contract directly relating to ownership, maintenance or use of the premises; criminal activity committed by or with the knowledge or consent of the insured; injury sustained as a result of an offense directly or indirectly related to a person's employment by the insured; injury arising out of business; or civic or public activities performed for pay by the insured.

Liability Endorsements-Business Pursuits

HO personal liability and medical payments coverage does not apply to activities arising out of a business in which the insured is not an owner or partner. This endorsement that exclusion, to provide coverage for bodily injury and property damage arising out of business pursuits at the insured's residence or away from the employer's premises after hours. This endorsement is useful to clerical office employees, sales representatives, collectors, messengers and teachers.

Conditions that Apply to HO Section I and II and DP Forms-Death

If the named insured or spouse dies, the policy will insure the deceased's legal representatives and any person having temporary custody or property covered under the policy at time of the death until appointment of the legal representative. In the HO policy, coverage continues for members of the deceased's household who had been insured at time of his death, as long as, they reside on the residence premises.

Coverage F (Medical Payments to Others)

It must be shown as the residence premises in the declarations and it includes other structures and grounds at that location. Coverage F applies to a person on the insured location with an insured's permission; or off the insured location, whose bodily injury arises out of a condition on the insured location or the ways immediately adjoining or is caused by an insured's activities; a residence employee in course of his employment by an insured; or an animal owned by or in the care of an insured.
