OSHA Penalties & Fines
Other penalties that can be assessed include:
a civil penalty of not more than $70,000.00 for each violation deemed to be a willful or repeated violation, with a minimum required penalty of not less than $5,000.00 for each willful violation.
If a penalty is issued,
a serious violation can carry a civil penalty of not more than $7,000.00 for each violation in which there is a substantial probability that death or serious physical harm could occur.
An other-than-serious violation
also carries maximum civil penalty of up to $7,000.00 for each violation.
Failure to correct a violation
carries a civil penalty of not more than $7,000.00 per day for each day during which the violation continues.
Making a false statement
carries a maximum criminal fine of not more than $10,000.00 or imprisonment of not more than six (6) months, or both, for falsifying representations or certifications on any application, record, report, plan or other document filed or required to be maintained.
Violations of any posting requirements
carry a civil penalty of up to $7,000.00 for each separate violation.
No penalties are issued for
other-than-serious violations unless there are ten or more citations.
If the conviction is for a second offense,
the criminal penalty is punishment of a fine of not more than $20,000.00 or by imprisonment of not more than one (1) year, or both.
If the willful violation causes death to an employee,
there is a provision for a criminal fin of not more than $10,000.00 or imprisonment of not more than six (6) months.
