Reconstruction Test
13th Amendment
Although Congress abolished slavery in the District of Columbia in 1862, and President Abraham Lincoln's Emancipation Proclamation ended the practice of slavery in rebellious states in 1863, at war's end in 1865 the question of slavery had not been resolved at the national level. The federal government required new state constitutions in former Confederate states to include the abolition of slavery, but there was nothing to prevent states from reinstituting the practice with revised state constitutions. Senators Lyman Trumbull of Illinois, Charles Sumner of Massachusetts, and John Henderson of Missouri, sponsored resolutions for a constitutional amendment to abolish slavery nationwide. The Thirteenth Amendment, ratified by the states on December 6, 1865, abolished slavery "within the United States, or any place subject to their jurisdiction." Congress required former Confederate states to ratify the Thirteenth Amendment as a condition of regaining federal representation.
15th Amendment
As a member of the Senate Committee on the Judiciary, William Stewart of Nevada guided the Fifteenth Amendment through the Senate. Ratified February 3, 1870, the amendment prohibited states from disenfranchising voters "on account of race, color, or previous condition of servitude." The amendment left open the possibility, however, that states could institute voter qualifications equally to all races and many former confederate states took advantage of this provision, instituting poll taxes, and literacy tests, among other qualifications.
Election of 1868 Seymour vs Grant
As the presidential election of 1868 drew near, Republicans nominated Civil War hero Ulysses S. Grant. Although Grant had never held public office, he had been a successful Union general, was popular in the North, and served as a reminder that Republicans had won the war. Democrats nominated Horatio Seymour, a former governor of New York who opposed emancipation, supported states' rights, and wanted to regain control of Reconstruction from Congress. Although Grant received 214 electoral votes to Seymour's 80, he won the popular vote by only 300,000, a slim margin. Republicans maintained control of Congress.
Carpetbaggers and Scalawags
During and immediately after the Civil War, many northerners headed to the southern states, driven by hopes of economic gain, a desire to work on behalf of the newly emancipated slaves or a combination of both. These "carpetbaggers"-whom many in the South viewed as opportunists looking to exploit and profit from the region's misfortunes-supported the Republican Party, and would play a central role in shaping new southern governments during Reconstruction. In addition to carpetbaggers and freed African Americans, the majority of Republican support in the South came from white southerners who for various reasons saw more of an advantage in backing the policies of Reconstruction than in opposing them. Critics referred derisively to these southerners as "scalawags."
Jim Crow Laws
From the late 1870s, Southern state legislatures, no longer controlled by carpetbaggers and freedmen, passed laws requiring the separation of whites from "persons of colour" in public transportation and schools. Generally, anyone of ascertainable or strongly suspected black ancestry in any degree was for this purpose a "person of colour"; the pre-Civil War distinction favouring those whose ancestry was known to be mixed—particularly the half-French "free persons of colour" in Louisiana—was abandoned. The segregation principle was extended to parks, cemeteries, theatres, and restaurants in an effort to prevent any contact between blacks and whites as equals. It was codified on local and state levels and most famously with the "separate but equal" decision of the U.S. Supreme Court in Plessy v. Ferguson (1896).
Compromise of 1877
Immediately after the presidential election of 1876, it became clear that the outcome of the race hinged largely on disputed returns from Florida, Louisiana and South Carolina-the only three states in the South with Reconstruction-era Republican governments still in power. As a bipartisan congressional commission debated over the outcome early in 1877, allies of the Republican Party candidate Rutherford Hayes met in secret with moderate southern Democrats in order to negotiate acceptance of Hayes' election. The Democrats agreed not to block Hayes' victory on the condition that Republicans withdraw all federal troops from the South, thus consolidating Democratic control over the region. As a result of the so-called Compromise of 1877 (or Compromise of 1876), Florida, Louisiana and South Carolina became Democratic once again, effectively marking the end of the Reconstruction era.
1867 Reconstruction Act
Military Reconstruction Act or simply the Reconstruction Act, the bill reduced the secessionist states to little more than conquered territory, dividing them into five military districts, each governed by a Union general. Congress declared martial law in the territories, dispatching troops to keep the peace and protect former slaves.
14th Amendment
Ratified July 9, 1868, the Fourteenth Amendment granted citizenship to all persons "born or naturalized in the United States," including former slaves, and provided all citizens with "equal protection under the laws," extending the provisions of the Bill of Rights to the states. The amendment authorized the government to punish states that abridged citizens' right to vote by proportionally reducing their representation in Congress. It banned those who "engaged in insurrection" against the United States from holding any civil, military, or elected office without the approval of two-thirds of the House and Senate. The amendment prohibited former Confederate states from repaying war debts and compensating former slave owners for the emancipation of their slaves. Finally, it granted Congress the power to enforce this amendment, a provision that led to the passage of other landmark legislation in the 20th century, including the Civil Rights Act of 1964, and the Voting Rights Act of 1965. Congress required former Confederate states to ratify the Fourteenth Amendment as a condition of regaining federal representation.
Freedmans Bureau
The U.S. Bureau of Refugees, Freedmen and Abandoned Lands, popularly known as the Freedmen's Bureau, was established in 1865 by Congress to help former black slaves and poor whites in the South in the aftermath of the U.S. Civil War (1861-65). Some 4 million slaves gained their freedom as a result of the Union victory in the war, which left many communities in ruins and destroyed the South's plantation-based economy. The Freedmen's Bureau provided food, housing and medical aid, established schools and offered legal assistance. It also attempted to settle former slaves on Confederate lands confiscated or abandoned during the war. However, the bureau was prevented from fully carrying out its programs due to a shortage of funds and personnel, along with the politics of race and Reconstruction. In 1872, Congress, in part under pressure from white Southerners, shut the bureau.
Black Codes
The Union victory in the Civil War may have given some 4 million slaves their freedom, but African Americans faced a new onslaught of obstacles and injustices during the Reconstruction era (1865-1877). By late 1865, when the 13th Amendment officially outlawed the institution of slavery, the question of freed blacks' status in the postwar South was still very much unresolved. Under the lenient Reconstruction policies of President Andrew Johnson, white southerners reestablished civil authority in the former Confederate states in 1865 and 1866. They enacted a series of restrictive laws known as "black codes," which were designed to restrict freed blacks' activity and ensure their availability as a labor force now that slavery had been abolished. For instance, many states required blacks to sign yearly labor contracts; if they refused, they risked being arrested as vagrants and fined or forced into unpaid labor. Northern outrage over the black codes helped undermine support for Johnson's policies, and by late 1866 control over Reconstruction had shifted to the more radical wing of the Republican Party in Congress.
Tenure of Office Act and Impeachment
The bill sought to protect prominent Republicans in the Johnson administration by forbidding their removal without congressional consent. Although the act applied to all officeholders whose appointment required congressional approval, Republicans were specifically aiming to keep Secretary of War Edwin M. Stanton in office, because Stanton was the Republicans' conduit for controlling the U.S. military. Defiantly, Johnson ignored the act, fired Stanton in the summer of 1867 (while Congress was in recess), and replaced him with Union general Ulysses S. Grant. Afraid that Johnson would end Military Reconstruction in the South, Congress ordered him to reinstate Stanton when it reconvened in 1868. Johnson refused, but Grant resigned, and Congress put Edwin M. Stanton back in office over the president's objections.House Republicans, tired of presidential vetoes that blocked Military Reconstruction, impeached Johnson by a vote of 126-47 for violating the Tenure of Office Act.
1870-71 Enforcement Acts
criminal codes that protected blacks' right to vote, hold office, serve on juries, and receive equal protection of laws. If the states failed to act, the laws allowed the federal government to intervene. The target of the acts was the Ku Klux Klan, whose members were murdering many blacks and some whites because they voted, held office, or were involved with schools.
