In this situation a Bailment has been created for the Sole Benefit of the Bailor.

MUTUAL BENEFIT BAILMENTS

An example of this would be when Jim goes to his neighbor and asks the neighbor if he can borrow his lawn mower.

CONSTRUCTIVE BAILMENT

For example, the Legislative branch passes a piece of legislation and the President then decides whether he will sign it. If he signs it then it becomes law and if its constitutionality is challenged the Judiciary will decide that issue. If, for example, the President vetoes the passed legislation, then the Legislative branch has the ability to override the veto. Joan would have a case against Marvin for Libel, since there is a permanent record of the statement (letter) and there was publication of the statement. The element of publication is satisfied by the fact that Marvin dictated the letter to Rose, his secretary. Rose is the third person.

This means that if the employee's job is to drive the hearse at the funeral, and he is drunk when he drives it and causes an accident, then the Employer would be liable.
