Ernesto Miranda was accused of kidnapping and rape. He was questioned at the police station and was not advised of his right to an attorney or to remain silent. He signed a written confession to his crimes and found guilty in the trial, and was sentenced to 20-30 years in prison. The Fifth Amendment protects criminal defendants from having to testify if they may incriminate themselves through the testimony. The Sixth Amendment gives the right to a speedy trial, the right to a lawyer, and the right to an impartial jury. The Supreme Court decision said 5-4 that an arrested individual is entitled to rights against self-incrimination and an attorney under the 5th and 6th Amendments of the United States Constitution. After the Miranda decision, the nation's police departments were required to inform arrested persons or suspects of their rights. This is called the Miranda warning.

Explain why the Bill of Rights was created in the first place?

The Bill of Rights is the first of 10 amendments to the Constitution. To ensure ratification of the document, the First Congress proposed the Bill of Rights to protect individual rights by limiting government power. The Bill of Rights guarantees human rights, such as freedom of speech, press, and religion. It sets rules not delegated to the Federal government to the people or the states. Between the antifederalists and federalists, the anti federalists favored the Bill of Rights because they said it would protect America's civil liberties. They didn't want too much power in the national government. The Federalists, including James Madison, thought the Bill of Rights was unnecessary because they thought no list of rights could be complete and that therefore it was best to make no list at all. James madison is important because he is the 4th president and wrote the first 10 amendmnets to the consitution.
