In Buchanan vs. Warley, Warley had planned to buy Buchanan's house. When Warley learned that he wouldn't be allowed to live there because of a city ordinance banning blacks from moving to a block where the majority of residents were white, he backed out of the sale. The seller sued him for backing out, but Warley said the city ordinance was a valid reason to not complete the sale. Buchanan then fought the city ordinance, claiming it violated the 14th Amendment. The Supreme Court agreed with Buchanan. The city ordinance was not constitutional.

Before beginning development of a condominium building, the developer must record a declaration of condominium in the county records where the property will be located. Before there can be an association, there must be a document called the articles of incorporation. This creates the homeowners association, a non-profit organization responsible for operating the developed property. The bylaws contain the rules that condominium owners must follow. The developer must also supply an estimated operating budget, which is used to determine the monthly assessment (condo association or HOA) fees paid by unit owners.

At the beginning of any brokerage relationship, the broker should disclose their right to place a lien, citing the appropriate Florida statute. The most complete form of ownership and bundle of rights in real property is known as a fee simple estate. A life estate is also a freehold estate, but it doesn't convey the entire bundle of rights because the owner holds the estate for only their lifetime. When the owner of a life estate dies and the property reverts to the original grantor (owner), it is known as an estate in reversion. If, instead of reverting to the original owner, the property goes to a third party, that person owns a remainderman estate.

It's important to comply with fair housing laws because your personal reputation and the reputation of your industry are involved. Educating your clients about fair housing laws helps them minimize their risks, as well. Fair housing affects your community and impacts society as a whole because the socio-economic significance goes beyond limiting a person's individual choice of where to live. Ruby's first step should be to give notice of eviction to her tenant and allow the tenant the appropriate amount of time to get caught up on rent. If the tenant fails to do so within the three-day time limit, Ruby would then go to the court clerk to file a complaint for eviction and the tenant would be allowed five days to respond to the notice. Depending on whether the tenant responds to the notice, the judge will issue a final order to determine who gets possession of the property.
