Administration hearings: procedures
- after receipt of complaint, the executive director shall inform accused party -Accused party has 20 days to file a written answer -Complaining party will receive copy of answer within 20 days, then files a reply -All this is referred to Committee on Investigations -Committee comprised of 3 members of the board, one serves as chairman -As part of investigation, may assign the complaint to the Board's investigator, may invite the complaining and accused party for oral statements, conduct any other type of investigation -If probable cause found but disciplinary hearing not warranted, Committee may issue reprimand to accused party. -A Board member who has served on the Committee is disqualified to act as presiding officer or member of Board assigned to render a decision in any admin proceeding. -Board may assess and recover costs incurred by the Board during this process. -Civil monetary penalty up to $5000 for each violation may be imposed and collected
Minimum standards for drug procedures
1) All controlled substances stored, maintained, administered, dispensed and prescribed in compliance with federal and state laws 2) Except for labeled manufactured drugs, all drugs dispensed with a lable containing: -name, address and telephone number of the facility -name of client -animal identification -date dispensed -direction for use -name and strength of drug -name of prescribing veterinarian
Credit hours can be earned:
1) Attendance at in-depth seminars ( AVMA, AAHA, NCVMA) 2) Only 1 credit hour may be acquired from attendance at a local sectional association meeting 3) Only 3 hours/year can be from video, audio or computer based training 4) Each DVM will keep a record of CE earned 5) Not required to earn CE in the calendar year of graduation
Continuing Education
1) DVM earn 20 credit hours/year 2) Vet Tech earn 12 credit hours every 2 years 3) DVM may be granted an extension, not to exceed 6 months with evidence of incapacitating ilness. If said illness is likely to result in the death of the DVM, they may be exempt from the unearned portion of the CE for that renewal period.
Powers of the Board
1) Examine and determine the qualifications and fitness of applicants for license 2)Issue, renew, deny, suspend or revoke license, limited licens or temporary permits 3) Conduct investigations for the violations or grounds for disciplining veterinarians 4) Employ full or part-time personell, purchase or rent necessary office space, equipment or supplies, puchase liability insurance to cover activities of the board 5) Appoint from its own membership one or more members to act as representatives 6) Adopt, amend or repel rules necessary for its government
Minimum standards of radiography
1) Facility have capability of obtaining diagnostic quality radiographs at facility or through consultation service 2) Use and maintain radiology equipment in accordance with federal, state laws 3) All personell using radiology equipment shall wear badges
Types of intervention
1) Intervention of right 2) Permissive intervention 3) Discretionary intervention
Vet Tech, student interns, student preceptees
1) Must be registered with Board 2) function under supervision of a vet 3) May not perform an irreversible change in the animal 4) student interns may perform surgery and administer drugs under supervision 5) preceptees may make calls, diagnoses, treatments or prescriptions
Minimum Standards for all facilities
1) Provide heating, cooling and ventilation sufficient for the comfort of the animals and staff 2) Lighting sufficient for the tasks conducted in the rooms 3) Hot and cold running water along with toilets and lavatories for staff and clients 4) Area dedicated to storage, shall be sanitary 5) Interior and exterior receptacles for waste disposal 6) employ a procedure for the prompt and sanitary disposal of dead animals. Dead animals held on premises shall be refrigerated 7) All interior spaces will be clean and orderly
Temporary permit
1) Qualified applicent pending examination 2) Non-resident validly licensed in another state for no more than 60 days 3) Temporary permits may be revoked by majority vote without a hearing
Fees
1) Registration of professional corporation: $150 2) NC license exam: $250 3) Inspection of a practice facility: $125 4) Issuance or renewal of a license: $150 5) Issuance or renewal of vet facility certificate: $150 6) Issuance or renewal of zoo vet certificate: $150 7) Reinstatement of expired license: $100 8) Issuance or renewal of vet tech registration: $50 9) Issuance of vet student intern: $25 10) Issuance of vet student preceptee: $25 11) Late fee for renewal of license: $50 12) Issuance of temporary permit: $150
Board Membership discontinues if:
1) Transfer of legal residence to another state 2) own or be employed by any wholesale or jobbing house dealing in supplies, equipment or instruments used or useful in practice 3) License revoked for any reason
Abandoment of Animals
1) Unclaimed for more than 10 days after written notice by registered or certified mail. 2) The giving of notice to the owner relieves the veterinarian of further liability for disposal
Mandatory standards of conduct: discipline
1) Untrue/deceitful statements in any application to the Board or any professional relationship 2) Acting to enable others to evade the animal and public health requirements related to practice 3) Bribing or promising to bribe 4) Defrauding or willfully misleading the Board or professional associate 5) Violating laws of North Carolina or any other state related to practicing 6) communicating verbally or written discrediting the reputation, integrity or professional competence of a vet, permittee, etc...
Application for license; qualifications
1) Written application 2) graduate of accredited vet school, good moral character 3) application from grad of non-accredited college outside of US may not be considered until successful completion of the program by the Educational Commission of Foreign Veterinary Graduates of the AVMA. Including examinations
Minimum standards of record keeping
1) Written or computerized and easily retrievable. Include pertinent data. 2) Records kept for 3 years following last visit or discharge 3) Maintained by individual animal for companion pet animals examined/treated 4) Recordkeeping shall not apply to treatment of economic animals
Grounds for disciplinary action
1) employment of fraud, misrepresentation, or deception in obtaining license 2) Adjudication of insanity or incompetence 3) impairment of a person holding a license; use of alcohol, drugs or controlled substances 4) Use of advertising or solicitation which is false, misleading or deceptive 5) Conviction of a felony or other public offense involving moral turpitude 6) Incompetence, gross negligence or other malpractice 7) Having professional association with any person practicing unlawfully 8) Fraud or dishonesty in application or reporting of any test for disease in animals 9) Failure to keep premises clean and sanitary or regulations concerning waste disposal 10) Failure to report or making false report of contagious or infectious disease 11) Dishonesty or gross negligence in the inspection of foodstuffs or issuance of health or inspection certificates 12) Conviction of a criminal offense involving cruelty to animals 13) Revocation of a license to practice medicine in another state 14) Unprofessional conduct as defined in regulations adopted by the Board 15) Conviction of a federal or state criminal offense 16) The illegal use, dispenseing, prescription, sale or handling of controlled substances, other drugs or medicines 17) Failure to comply with regulations of USDA regarding biologics, drugs, medicines 18) Selling, dispensing, prescribing or allowing the sale of medicines without a veterinary-client-patient relationship 19) Acts or behavior constituting fraud, dishonesty or misrepresentation in dealing with the Board or in the veterinary-client-patient relationship
Special Powers of the board
1) fix minimum standards for CE for vets and techs 2) Inspect any facilities 3) Upon complaint or information received by the board, prohibit through summary emergency order of the Board the operation of any veterinary facility that the board determines is endangering or may endanger the public health or safety or the welfare and safety of animals 4) Provide special registration for "vet techs", "veterinary student interns" and "veterinary student preceptees" 5) Provide requirements for the inactive status of license and limited veterinary licenses 6) Set and require fees
Examination rooms shall have:
1) lined waste receptacles or chutes 2) A sink with disposable towels either in or adjacent to or convenient to the room 3) A table with an impervious surface, sanitized between patients
Surgery minimum standards
1) performed in a room designated and reserved for surgery 2) Clean, orderly, well lighted 3) Sterilization shall include steam pressure sterilizer or autoclave 4) Instruments & equipment used in surgery room appropriate for type of surgery 5) Storage in surgery room limited to items related to surgery and surgical procedures 6) Emergency drugs readily available to surgery area 7) Operating table constructed of smooth, impervious material 8) Separate surgical preparation area 9) Available sterilized instruments, gowns, towels, drapes, gloves, caps and masks 10) Regulated oxygen under positive pressure available
In-house laboratory minimum standards:
1) storage space sufficient for necessary equipment and materials 2) refrigeration sufficient for drugs and medicines as well as refrigeration of dead animals prior to disposal 3) Minimum in-house tests: urine, PCV, fecal float, skin scraping, heartworm
How many Board members appointed by Governor (5)
5 members chosen by governor. 4 of these have been legal residents of and licensed to practice in this state for no less than 5 years preceding their appointment. The other member shall not be licensed or registered and shall represent the public at large. Each member appointed by the governor shall reside in a different congressional district
Partnership, corporate, or sole proprietorship
A veterinary medical practice may be conducted as a sole proprietorship, by a partenrship or by a duly registered professional corporation. When conducted as a partnership, all partners must be licensed.
Veterinary technician
A) has successfully completed a post-high school course and is registered with the Board as a vet tech B) holds a DVM from a CVM who is registered with the Board as a vet tech
Veterinary-client-patient relationship
A) the veterinarian has assumed the responsibility for making medical judgements regarding the health of the animal and the client has agreed to follow the instruction of the veterinarian B) there is sufficient knowledge of the animal by the veterinarian to initiate at least a general or preliminary diagnosis of the condition. C) the practicing veterinarian is readily avalable or provides for follow-up in case of adverse reactions or failure of regimen of therapy
Practice of veterinary medicine
A) to diagnose, treat, correct, change, relieve, or prevent animal disease, deformity, defect, injury, or other physical or mental conditions; including prescription or administration of any drug, medicine, biologic, apparatus, application, anesthetic, or other therapeutic or diagnostic substance B)To represent an ability and willingness to do any act described above C) To use any title, words, abbreviations, or letters in a manner of under circumstances which induce the belief that the person using them is qualified to do any act listed in section A
Current Information
All Licensees shall report changes in mailing address, professional association or dissolution of professional relationship to the executive director within 60 days.
Animal
Any animal, mammal other than man and includes birds, fish, reptiles, wild or domestic, living or dead
Reinstatement
Any person whose license is suspended or revoked may be relicensed or reinstated without examination by majority vote of the Board on written application.
Accredited school of veterinary medicine
Any veterinary college or division of a university or college that offers the degree of DVM or its equivalent and that conforms to the standards required for accreditation by the AVMA
General Assembly (2)
Appoint one member to the board who is a resident and licensed for no less than 5 years preceding appointment. Also appoint one member legal resident and registered veterinary technician for no less than 5 years.
Commissioner of Agriculture (1)
Biennially appoints the State Veterinarian or another veterinarian from a staff of a North Carolina department or institute. Legal resident, licensed no less than 5 years.
Zoo veterinary certificates
Board can issue certificates in lieu of a license, persons holding these certificates shall be subject to the jurisdiction of the board
Notice of hearing
Board shall give notice to party or parties in a contested case no less than 15 days prior to hearing
Faculty certificate
Faculty at NCSU CVM may receive a faculty certificate which exempts them from requirements of licensing. This automatically expires when the holder's relationship with the school is terminated.
License renewal
Failure to renew within 60 days of expiration results in automatic revocation of the license. May renew an expired license at any time within 2 years following its expiration
Final decision
In all cases the Board will issue its decision within 60 days after its next regularly scheduled meeting following the close fo the hearing
Zoo veterinary certificate
May be issued in lieu of a license if the holder is employed by the North Carolina State Zoo. Renewed annually each calendar year.
Meeting of the Board
Meets at least 4 times/year. Other meetings called by the president. At the last meeting of the fiscal year the Board shall organize by electing for the following year, a president, a secretary-treasurer, and other officers. Officers serve 1 year terms. President serves as chairman of meetings.
Name of Practice
Must be pre-approved by the board to avoid duplication. No proper names of persons other than licensees may be included in the name.
Board term of office
No member shall serve more than 2 complete consecutive five year terms, except that each member shall serve until his successor is appointed and qualifies.
Applicants Licensed in other states
Only NC state exam if applicant provides evidence of: 1) currently active practitioner in good standing 2) Has practiced at least 3 of the 5 years immediately preceeding application 3) Currently holds an active license in another state 4) No disciplinary proceeding or unresolved complaint pending 5) Licensure requirements in the other state are equivalent 6) Achieved a passing score on the written NC license examination
Unauthorized practice; penalty
Practicing without license, without renewing, with revoked license, guilty of Class 1 misdemeanor.
Emergency facility
Primary function is the receiving, treatment and monitoring of emergency patients during specified hours of operation. A veterinarian is in attendance at all hours of operation.
Examinations
The Board shall hold at least 1 exam during each year and may hold additional exams as necessary
Rule-making petitions
The board shall grant or deny a petition for rule-making within 120 days of receiving.
Cruelty to animals
To willfully overdrive, overload, wound, injure, torture, torment, deprive of necessary sustenance, cruelly beat, needlessly mutiliate or kill any animal, or cause or procure any of these acts to be done to an animal; provided that the words "torture", "torment", or "cruelty" include every act, omission, or neglect causing or permitting unjustifiable physical pain, suffering, or death
Animal Health Center or Animal Medical Center
Veterinary practice facility in which consultative, clinical, and hospital services are rendered and in which a large staff of basic and applied veterinary scientist perform significant research and conduct advanced professional education programs
Limited veterinary license or limited license
a license issued by the state board under authority of this article that specifically by its terms, restricts the scope or area of practice of veterinary medicine by the holder of the limited license; provided, that no limited license shall confer or debote an area of specialty of the holder of this limited veterinary license; and provided futher, that unless otherwise provided by board rule, the licensing requirements shall be identical to those specified for veterinary license
Veterinary student intern
a person enrolled in an accredited veterinary college, has completed the third year and is registered the the board as a veterinary student intern
Veterinary student preceptee
a person pursuing a DVM in an accredited school that has a preceptor or extern program and has registered with the Boad as veterinary student preceptee
Veterinarian
a person who has received a DVM from an accredited school of veterinary medicine and who is licensed by the Board to practice veterinary medicine
Discipline of licensees
a)Board may revoke, suspend license, discipline in other ways, deny license. b) Board may impose and collect a civil monetary penalty up to $5000 for each violation c) Grounds for disciplinary action include but not limited to
Person
any individual, firm, partnership, association, joint venture, cooperative, corporation, or any other group or combination acting in concert; and whetehr or not acting as a principal, trustee, fiduciary receiver, or as the successor in interest, assignee, agent, factor, servant, employee, director, officer, or any other representative of such person
Veterinary Hospital or Animal Hospital
facility in which the practice conducted includes the confinement as well as the treatment of patients
Animal dentistry
the treatment, extraction, cleaning, adjustment, or "floating" or an animal's teeth, and treatment of an animal's gums
On-call emergency service
veterinary medical service ata practice facility, including a mobile facility, where veterinarians and staff are not on the premises during all hours of operation
Mobile facility
veterinary practice conducted froma vehicle with special medical or surgical facilities or from a vehicle suitable only for house or farm calls; provided the veterinary medical practice shall have a permanent base of operation with a published address and telephone facilities for making appointments or responding to emergencies
Veterinary clinic or animal clinic
veterinary practice facility in which the practice conducted is essentailly an out-patient practive
Office
veterinary practice facility where a limited or consultative practice is conducted; no facilites for housing of patients
Veterinary medicine
veterinary surgery, obstetrics, dentistry, and all other branches or specialties
