"Pass Through Clause"

"pass" the obligations and restrictions of the general contractor from their contract with the owner on to the subcontractor - commonly used with pay applications when an owner may "cut" or reduce the general contractors pay application which then allows the general to cut the subcontractors payment - these kinds of clauses also link when the general contractor receives funds from the owner to when they are required to pay their subcontractors - often referred to as a "pay when paid clause"

- most hazardous - cave-ins highest risk - also include: asphyzlation, inhalation of toxic materials (fuel fumes), fires, and electrocution by serving underground utility lines - employees are required to be protected from cave-ins through sloping, shoring, and shielding for all trenches 5' in depth or more - trenches over 20' in depth must have the protection systems designed by a professional engineer

Type A Soil

- most stable with an unconfined compressive strength of 1.5 tons per sq ft - clay, clay loam, and sandy clay - maximum allowable slope which are less than 20' in depth is 3/4:1

- move and lift materials - increase profitability, worker productivity, and jobsite safety

Ladders

- must be provided when there is break in elevation of 19" or more - required to support at least 4 times the maximum intended load - however, this can be reduced to 3.3 times for extra-heavy duty, 1A ladders - Non-self supporting ladders (ladders that lean up against walls) should be positioned at an angle where the horizontal distance from the top support to the foot of the ladder is 1/4 the working length of the ladder - when using portable ladders to access the upper landing surface, the side rails must extend at least 3' above the upper landing surface

Stairs

- must be provided when there is break in elevation of 19" or more - stairways with 4 or more rises or 30" in height must be equipped with at least one handrail - handrails are also required on all unprotected sides or edges of stairways - stairs should be installed between 30 and 50 degrees with a uniform height and depth of the treads and risers

Cost Control

- must control labor, material, equipment and subcontracts - labor is one of the most critical as it fluctuates greatly and can greatly exceed the budget - compare the actual labor costs to the budgeted labor costs and project the final cost - budgeted labor costs are obtained from the estimate created during preconstruction - the actual labor costs are obtained from labor reports often provided by the project accountant

Cost Plus Contract

- the contractor is paid for all direct costs such as labor, material, equipment, subcontractors, and field supervision plus an agreed upon fee - the fee is typically a percentage of the cost of the work - normally used in cases where the scope of work is not easily defined - have the advantage of having the owner only pay for what the project needs without a premium for the contractors risk - bc of the low risk, contractors fee is typically lower than on a lump sum - contracts may be solely based on the "time and material" needed to complete the job without any set limit to the costs of have a GMP which caps the costs the owner will be responsible for

Design Build Delivery Method

- the owner contracts with a single entity for both design and construction services - entities may be a single design-build firm with in-house design and construction employees, or a temporary partnership between a design and construction firm (through a joint venture)

Substantial Completion

- triggers the release of retainage - release of retainage can concern owners as this eliminates the financial leverage over the contractor

Differential Leveling

- where the elevations of points on a map or survey are determined - telescope with magnification to read dimensions on a grade rod in reference to known elevations - transpose an elevation from a known benchmark elevation to other points whose elevations are not known - level with the datum plane and can read the measurements of grade rods that are in its line of sight and its horizontal plane

Retainage

to withhold a percentage of the progress payment from the contractor as an incentive for the contractor to complete the project - typically released once the contractor is substantially complete

Backhoe

tractor like piece of equipment that has a two-part articulated arm and bucket mounted to the back and a loader bucket equipped to the front - used in shallow and narrow trench excavations, utilities, and material handling

Dozer

tractor-like piece of equipment with a front-mounted blade - may be wheel mounted but are most often track mounted - used in clearing and leveling of a jobsite and in pushing/spreading large quantities of materials

Excavation Egress

trenches 4' or more must have a fixed mean of egress - ladder: top must extend 3' above the top of the trench - worker must not have to travel more than 25' to the nearest ladder or other means of egress - multiple ladders are spaced no more than 50' apart

Bid Form

typically a 1-2 page sheet where the contractor provides the amount of the bid, price breakdowns, alternate prices, list of key subs, and acknowledgement of addendum received

Back Charges

typically deductive change orders caused as a result of one contractor causing additional costs to be incurred by another

use arrows to represent the logic or relationship between the activities - activities are represented by the nodes - much more commonly used in construction

Hydraulic Submersible Pumps

use hydraulics to power the pumps and are ideal when the pump can't be physically placed near the water source

Centrifugal Pumps

used for open water with high concentrations of debris and trash

Surveyor's Measuring Tape

used to determine the distance between 2 points; most typically in the horizontal direction - come in 100', 200', and 300' lengths and are often made of fiberglass, PVC or steel - steel is durable but expands in heat and may give an inaccurate reading - correction factors to account for expansion at high temperatures may be included with the instrument

Bid Bond

used to ensure that the principal will honor their bid and enter into a contract with the obligee for the bid amount after the bid opening - usually covers the difference between the low bid and the second lowest bid - typically up to 10% of the bid price

Transits & Theodolites

used to measure horizontal and vertical angles - more modern and have a few automatic functions

Guardrails

used to protect against falls on leading edges of floors, stairs, and other surfaces - must include a top rail and mid rail - toe boards may be required if used for falling object protection - TOP RAIL: between 42" +/- 3" - MID RAIL: 21" +/- 3" - TOE BOARD: at least 3.5" in height - guardrail must resist a lateral load of 200 lbs at the top, 150 lbs at the mid and 50 lbs at the toe - cable can be used if they are flagged every 6'; maximum sag of 3" and same dimensions provided for traditional guardrails are maintained
