The whole point of the DEA is to eliminate drug trafficking and distribution and because they were given the authority to do that, them inforcing the Prescription Drug Marketing Act would fall under the "distribution" part because it created safer guidelines for the distribution of prescription drugs and the sale of counterfeit drugs. Since the leader of the DEA is appointed by the president at the time of an appointment, they would appoint someone with the same mindset as them when it comes to drugs and drugs distribution. If they appoint someone who doesn't care that much about drug distribution and doesn't prioritize it because the president themself has the same mindset, then the DEA won't be as powerful because that kind of mindset is what they will have to follow (it works vice versa as well). Congressional oversight of the DEA in the scene reflects the principle of checks and balances because Congress is there to make sure that the DEA doesn't enforce acts the are too harsh or acts that are unconstitutional which would count as a check between them. The DEA having the power to look into the drug usage and drug distribution of the country because they're professionals in their field and not letting other people or branches do that job for them is the balance in the situation because they get their portion of the job in the government and they don't do anyone else's and no one does theirs. If a case with a question about the Prescription Drug Marketing Act came before the court, the Supreme Court could have a ruling on whether or not the act is constitutional or unconstitutional and have a hearing. The actions of the Court could impact the ability of the DEA to carry out its effort to eliminate drug trafficking and distribution by ruling one of their acts, for example, the Prescription Drug Marketing Act, as unconstitutional which would limit their efforts in their goals.
