What is a "corporate/trade" name?

A dental facility is considered as utilizing a "corporate/trade" name when that name is not the full name and degree of the dentist owning or working in the facility (e.g., Mize Family Dentistry, Family Dentistry, South Mississippi Dental Facility, etc.). All corporate/trade names must be registered with and approved by the Board, and the Board must be provided the full names of all dentists employed by or owning the facility, as well as any alternate locations of the facility. Refer to Board Regulation 55.

May dental auxiliaries (dental hygienists and/or dental assistants) perform procedures on patients while the dentist is not in the office?

Absolutely not. This is a serious violation of the Mississippi Dental Practice Act. All auxiliaries must be under the "direct" supervision of a licensed Mississippi dentist; therefore, it is immaterial whether the dentist is "on the way to the office," "only out for lunch or an errand," "out due to illness or vacation," etc. Refer to Miss. Code Ann. §§73-9-3 and 73-9-5 and Board Regulation 13.

Can I include fees charged and/or services for "free" in my advertising?

Advertising that references a fee or fees, or a service for no fee, must clearly define the professional service being offered in the advertisement. Such advertised offers shall be presumed to include everything ordinarily required for such a service. No additional fees may be charged unless the advertisement includes the following disclaimer: "Additional fees may be incurred in individual cases". Refer to Board Regulation 43.

I see phrases such as "certified" dental assistant or "accredited" dental assisting program or school. What does the Board consider as a "certified" dental assistant or "accredited" dental assisting program or school?

Albeit someone may work as a dental assistant in the State of Mississippi without the need to be "licensed" as a dental assistant, if that person exposes radiographs as part of his/her dental assisting duties, that person must be issued a currently valid and renewed Mississippi Radiology Permit PRIOR TO exposing radiographs. For purposes of issuing Mississippi Radiology Permits, the Board ONLY recognizes the phrase "certified dental assistant" as being a dental assistant who currently has passed all requirements and examinations to receive certification by the Dental Assisting National Board, Inc. (DANB). Current DANB certification may be used to fulfill the requirements for being issued a Mississippi Radiology Permit. Additionally, the only "accredited dental assisting programs or schools" recognized by the Board for purposes of issuing Mississippi Radiology Permits are those dental assisting schools/programs that currently are accredited by the Commission on Dental Accreditation (CODA) through the American Dental Association (ADA). Graduation from an ADA/CODA-accredited dental assisting program may be used to fulfill the requirements for being issued a Mississippi Radiology Permit. For purposes of issuing radiology permits, only DANB-certified dental assistants or ADA/CODA-accredited dental assisting graduates are recognized by the Board. No other "certification" or "accreditation" are recognized by the Board and may be used as fulfilling the requirements for a Mississippi Radiology Permit. Refer to Board Regulation 25 for more information regarding the application for and issuance of Mississippi Radiology Permits.

Where can I obtain Board-approved on-line continuing education courses?

An excellent source of on-line continuing education is through the American Association of Dental Boards (AADB). The Board is a member of this nationally-recognized organization, who derives its membership from other state regulatory boards, specialty boards, and dental educators.

How has the Board defined Anxiolysis?

Anxiolysis (minimal sedation) has been defined as the pharmacological reduction of anxiety through the administration of a minor psychosedative/tranquilizer, which allows for uninterrupted interactive ability in a totally awake patient with no compromise in the ability to maintain a patent airway continuously and without assistance. The total dosage cannot exceed 1.5 MRD (maximum recommended dosage). Dentists administering anxiolysis (minimal sedation) shall prescribe only a single agent to each patient (no multiple drugs or combination drug regimens). *When the intent is minimal sedation for adults, the appropriate initial dosing of a single enteral drug is no more than the MRD of a drug that can be prescribed for unmonitored home use. Refer to Board Regulation 29.

What does the Board mean by stating that dental auxiliaries must be under the "direct" supervision of a licensed Mississippi dentist?

As noted earlier, all dental auxiliaries must be under the "direct" supervision of a licensed Mississippi dentist. The Board has defined the term "direct" supervision to mean the following: A dentist is physically present in the dental office or treatment facility, personally diagnoses the condition to be treated, authorizes the procedures to be performed, remains in the dental office or treatment facility while the procedures are being performed by the auxiliary, and evaluates the performance of the dental auxiliary. Refer to Board Regulation 13.

Are Mississippi dentists allowed to utilize Groupon and Groupon-like advertising strategies?

At its 08/10/2012 meeting, the Board discussed Groupon and Groupon-like advertising strategies and whether such would violate the Board's laws and regulations. At that meeting, the Board voted unanimously to issue the following ADVISORY NOTICE to all licensed Mississippi dentists who currently may be utilizing, or considering utilizing, these types of advertising strategies: ADVISORY FROM THE MISSISSIPPI STATE BOARD OF DENTAL EXAMINERS TO ALL DENTAL LICENSEES:At its 08/10/2012 meeting, the Board discussed Groupon and similar advertising strategies and whether such strategies constitute a violation of the Board's laws and regulations. At that meeting, the Board opined that dentists utilizing Groupon or similar services should be aware that offering discounts through Groupon-like services wherein fees are paid to the service constitutes fee-splitting when the payment is based upon a percentage of the fees collected or the number of referrals made. Dentists engaging in such a practice are deemed to be in violation of the American Dental Association's (ADA) "Principles of Ethics and Code of Professional Conduct," as well as Board Regulation 1, which formally adopts the Code. The Board also opined that no violation of its laws and regulations occurs if the fee paid to the Groupon-like service is a pre-set amount which does not vary based upon a percentage of the fees collected or the number of referrals made.

Is direct supervision required for dental hygienists who provide dental services SOLELY on tribal lands? In essence, does the Board even have authority over dental treatment rendererd on tribal lands?

At its 10/31/2014 meeting, the Board considered an inquiry as to whether licensed Mississippi dental hygienists working on TRIBAL LANDS are allowed to work under the general supervision of a licensed Mississippi dentist insofar as the application of fluoride varnish under "public health" auspices is concerned. Furthermore, the inquiry questioned whether the Board has authority over these dental auxiliaries when providing services on TRIBAL LANDS. Based upon its research and advice from legal counsel, the Board determined that if the Mississippi licensed dentist or dental auxiliary provides services ONLY TO TRIBAL MEMBERS AND ONLY ON TRIBAL LANDS, the Board has no jurisdiction other than should a complaint regarding quality of care issues insofar as patient treatment be filed with the Board, whereupon, the Board would investigate the complaint and work closely with tribal authorities. Furthermore, if the dentist or dental auxiliaries providing services ARE NOT licensed Mississippi dentists or dental auxiliaries, the Board would report such complaint to the state wherein such individuals are licensed. The Board reiterated that this determination applies ONLY to TRIBAL LANDS and ONLY for work performed on TRIBAL MEMBERS. This determination does NOT pertain to dental work performed on tribal land on non-tribal members. Refer to Board Regulation 13.

How does the Board's requirement for AEDs in all dental offices impact teaching institutions and the number of AEDs they are required to maintain?

At its 11/05/2010 meeting, the Board considered a question regarding the new Automated External Defibrillator (AED) requirement and how this impacts teaching institutions, such as the State's dental school, dental hygiene schools, and dental assisting schools insofar as the number of AEDs required for these institutions in the various clinical settings. The Board determined that a minimum of one fully functioning AED, or equivalent defibrillator, needs to be available in each clinical setting, i.e., those settings where patients receive care. Refer to Board Regulation 45.

Who is allowed to draw blood in a dentist's office?

At its 11/05/2010 meeting, the Board considered a question regarding who is allowed to draw blood in a dentist's office. Several questions were addressed regarding platelet rich plasma, e.g., due to the fact that this blood must be drawn and processed within an hour, can blood be drawn in the dental office; can the dentist draw blood; can a dental auxiliary draw blood; can a registered nurse draw blood in a dental office; and is there anyone who can draw blood in a dental office. The Board determined that documentation must be maintained noting the licensure or certification of any individual performing Venipuncture in the dental office

What forms of payment does the Board accept for license/permit renewal?

At this time, the Board accepts VISA, MasterCard, American Express, debit cards, and electronic funds transfer (EFT) payments for license and permit renewal.

How do I receive my certification card once my renewal has been finalized and accepted by the Board?

Certification cards will be transmitted to all licensees and permit holders via e-mail. Certification cards are attached as PDFs. Licensees and permit holders should print the certification card(s) attached to this e-mail to be displayed with their licenses/permits in all locations at which they work. Furthermore, licensees and permit holders are encouraged to save the attached certification card PDF on their computers in the event they need to print additional copies of their certification cards at a future date.

How many years should I keep my continuing education records?

Continuing education records must be maintained a minimum of three (3) years from the date of course attendance and should consist of certificates of course completion or correspondence from course sponsors verifying course attendance. Handwritten notes, registration receipts, check stubs, etc., are not acceptable as proof of attendance. Refer to Board Regulation 41.

Are dental auxiliaries allowed to carve and pack amalgams and place matrix bands?

Dental auxiliaries ARE NOT ALLOWED to carve and pack amalgams. However, at its 05/14/2010 meeting, the Board determined that dental auxiliaries ARE ALLOWED to place matrix bands. Refer to Board Regulation 13.

Do dental hygienists and radiology permit holders need to pay the assessment for the Professionals Health Network (PHN)?

Dental hygienists are required to pay the mandatory PHN renewal assessment. However, at this time, radiology permit holders are not required to pay the PHN assessment. Refer to Board Regulation 37

What happens if I fail to obtain and maintain CPR certification?

False certification of CPR courses or failure to comply with this Regulation shall subject the dentist or dental hygienist to disciplinary action, including license revocation. Fines will be assessed for failure to comply with this Regulation. Fines assessed herein will correspond to those fines enumerated in Board Regulation 41 for non-compliance with continuing education requirements. Refer to Board Regulation 45.

If I have been inactive for three (3) or more years and have not practiced in another state, what additional requirements do I need to meet to be granted active status?

If you have been inactive for three (3) or more years AND you have not actively practiced your profession in another state or jurisdiction, you also may have to successfully complete a clinical assessment prior to being granted active status, which may be determined by the Board on a case-by-case basis. Refer to Board Regulation 49.

How do I receive my renewal information?

In each odd-numbered year, dentists will be notified via e-mail no later than August 31 that the Board's on-line renewal portal is open. The Board can accommodate up to two (2) e-mail addresses for dentists. In each even-numbered year, dental hygienists and radiology permit holders will be notified via e-mail no later than August 31 that the Board's on-line renewal portal is open. At this time, the Board can accommodate only one (1) e-mail address for dental hygienists and radiology permit holders. ALL LICENEES AND PERMIT HOLDERS ARE REQUIRED TO PROVIDE A MINIMUM OF ONE (1) CURRENTLY VALID E-MAIL ADDRESS AND TO ENSURE THAT THIS E-MAIL ADDRESS IS UPDATED EACH TIME IT CHANGES.

Are dental auxiliaries allowed to administer Oraqix?

Licensed Mississippi dental hygienists, under the direct supervision of licensed Mississippi dentists, may administer Oraqix, a form of dental topical anesthetic, both supragingivally and subgingivally; however, dental assistants may not administer this product. Refer to Board Regulation 13.

How often do I need to take a refresher course for an Enteral Conscious Sedation Permit?

Licensed Mississippi dentists holding Mississippi anesthesia permits must provide proof during their biennial renewal that they are current in ACLS or PALS, or have a certificate from a Board-approved anesthesia review course. There is no specific mandate requiring refresher courses; however, the Board recommends that dentists holding Mississippi anesthesia permits avail themselves of the appropriate continuing education to ensure their patients' safety and welfare. Refer to Board Regulation 29.

Can I include in my advertising certain words and/or phrases which I feel describe my office, staff, and services rendered?

No advertisement by a licensed dentist shall contain any false, fraudulent, misleading, or deceptive statement or claim. Certain acts or omissions in the context of advertising by any licensee shall constitute unprofessional conduct as set forth in Miss. Code Ann. § 73-9-61(1)(l), and subject the licensee to disciplinary action. Refer to Board Regulation 43 for a detailed description of these acts and/or omissions.

Does the Board require DIRECT supervision for dental hygiene students during fundamentals laboratory sessions, wherein such students take impressions and practice with a dental instrument on each other?

No, but with STRICT limitations. At its 11/16/2012 meeting, the Board considered a request concerning DIRECT supervision for dental hygiene students during fundamentals laboratory sessions, wherein such students take impressions and practice with a dental instrument on each other and NOT the public-at-large. The Board determined that dental hygiene students ARE ALLOWED to practice dental hygiene under the guidelines of the Mississippi Dental Practice Act on fellow dental hygiene students and NOT the public-at-large, and ONLY while such students are actively enrolled in a Mississippi accredited dental hygiene program, all without the necessity of a dentist being present in the clinical facility. However, a member of the dental hygiene faculty MUST be present while such procedures are being performed.

Are there any drugs that cannot be used for enteral conscious sedation?

No. All drugs should be label specific or in peer-reviewed literature. Refer to Board Regulation 29.

Are Mississippi dentists allowed to advertise that they utilize the OraQuick Advance Rapid HIV ½ Antibody Test?

No. Although the Board determined that it is within the scope of practice for licensed Mississippi dentists to utilize the OraQuick Advance Rapid HIV ½ Antibody Test, it is not an appropriate mechanism for advertising. Refer to Board Regulation 43

If I prescribe Valium, or another sedative agent, for a patient to take before bed time the night before treatment and before the actual dental appointment, is that considered multiple dosing, thereby requiring an Enteral Conscious Sedation Permit?

No. An Enteral Conscious Sedation Permit is required whenever a licensed dentist utilizes inhalation agents and/or multiple doses of oral medications attempting to achieve a level of sedation beyond anxiolysis. Refer to Board Regulation 29.

Are dental hygienists who are required to successfully complete a clinical assessment in order to return to "active" status required to successfully complete a clinical refresher course prior to participating in the Board's clinical assessment?

No. At its 02/02/2007 meeting, the Board discussed the clinical assessment required by Board Regulation 49 for dental hygienists who have been inactive for three (3) or more years and who have not practiced their professions in any other jurisdiction during that time. At that meeting, the Board determined it would STRONGLY RECOMMEND that dental hygienists requesting a return to "active" status who have been listed on "inactive" status and not practicing dental hygiene in any jurisdiction for three (3) or more years complete a clinical refresher experience through an ADA-accredited dental hygiene program prior to participating in the Board's clinical assessment.

Are dental auxiliaries allowed to perform sulcular debridement of periodontal pockets using a Diode dental laser? Also, are dental hygienists allowed to utilize lasers for bacteria reduction and/or reduction of pocket depths?

No. At its 02/24/2006 meeting, the Board determined that licensed Mississippi dental hygienists and dental assistants are not allowed to perform sulcular debridement of periodontal pockets using a Diode dental laser. Furthermore, at its 03/12/2010 meeting, the Board considered a request as to whether licensed Mississippi dental hygienists are allowed to use lasers for bacteria reduction and/or reduction of pocket depths. The Board noted this question had been addressed by its 02/24/2006 determination, wherein the Board opined that licensed Mississippi dental hygienists and dental assistants ARE NOT allowed to perform sulcular debridement of periodontal pockets using a Diode dental laser. Refer to Board Regulation 13.

Are licensed Mississippi dental hygienists allowed to use soft tissue lasers to assist in the treatment of periodontal diseases and other soft tissue disorders?

No. At its 04/06/2007 meeting, the Board determined that licensed Mississippi dental hygienists are not allowed to use soft tissue lasers to assist in the treatment of periodontal diseases and other soft tissue disorders under the direct supervision of licensed Mississippi dentists. Refer to Board Regulation 13.

May I submit my personal check and a paper renewal form to renew my license or permit?

No. At its 05/13/2011 meeting, the Board determined that all licenses and permits MUST be renewed ONLY via the on-line method beginning with the 2011-2013 dental biennial renewal period and all renewal periods thereafter. PAPER RENEWAL FORMS NO LONGER WILL BE AVAILABLE. Dentists renew for their two-year cycle every odd-numbered year, and dental hygienists and radiology permit holders renew for their two-year cycle every even-numbered year.

Are dental auxiliaries allowed to remove facial hair with lasers in a dental office?

No. At its 06/16/2006 meeting, the Board determined that licensed Mississippi dental hygienists and dental assistants are not allowed to remove facial hair with lasers in a dental office. Refer to Board Regulation 13.

Can Mississippi anesthesia permit holders substitute the King Tube as an advanced airway instead of the currently required/listed laryngoscope and endotracheal tubes noted on the Board's anesthesia permit site visit form?

No. At its 07/25/2014 meeting, the Board considered an inquiry concerning mandated equipment for anesthesia permits and whether the King Tube could be utilized as an advanced airway instead of the currently required/listed laryngoscope and endotracheal tubes noted on the Board's anesthesia permit site visit form. The Board determined that the King Tube could NOT be utilized in lieu of the laryngoscope and endotracheal tubes. Albeit, the Board agreed that a licensee can have multiple airway adjuncts in the facility, nonetheless, the accepted standard of care is an endotracheal tube and laryngoscope. Refer to Board Regulation 29.

Is a licensed Mississippi dentist allowed to delegate the taking of alginate impressions to dental auxiliaries insofar as such impressions being taken for space maintainers, e.g., band and loop or other temporary appliances for maintaining space due to premature loss of primary dentition?

No. At its 07/29/2016 meeting, the Board considered a request concerning the above delegation to both dental hygienists and dental assistants, and it determined that, pursuant to guidelines already set forth in Board Regulation 13, item 4 under "Delegation of Duties to Dental Auxiliaries," dental auxiliaries are NOT ALLOWED to take impressions for space maintainers, such as band and loop or other temporary appliances for maintaining space due to premature loss of primary dentition, inasmuch as Board Regulation 13 already prohibits dental auxiliaries from the "taking of any impression of the human mouth or oral structure that will be used in the restoration, repair, or replacement of any natural or artificial teeth or for the fabrication or repair of any dental appliance." Refer to Board Regulation 13.

Are dental auxiliaries allowed to tighten dental implants?

No. At its 08/19/2011 meeting, the Board considered whether the tightening of dental implants may be delegated to dental auxiliaries, and the Board voted to amend item 5 of Board Regulation 13 to NOT allow "[t]he placement, cementation, or final torquing of inlays, permanent crowns, fixed bridges, removable bridges, partial dentures, full dentures, or implant abutments" to be delegated to dental auxiliaries. Refer to Board Regulation 13.

Are Mississippi dentists allowed to advertise earned non-health credentials such as masters' degrees or doctoral degrees, and earned diplomate status in dental organizations such as the Dental Organization for Conscious Sedation (DOCS), e.g., FDOCS and DDOCS diplomate status?

No. At its 10/18/2013 meeting, the Board determined that advertisement of earned non-health credentials and earned diplomate status, such as FDOCS and DDOCS, was NOT ALLOWED pursuant to the American Dental Association's (ADA) "Principles of Ethics and Code of Professional Conduct," Section 5.F.3. Refer to Board Regulation 43 and the ADA Code of Ethics.

Are dental, dental hygiene, and dental assisting students currently enrolled in these Mississippi ADA-accredited programs required to apply for Mississippi Radiology Permits to administer radiographs?

No. Dental students, dental hygiene students, and dental assisting students actively enrolled in Mississippi ADA-accredited dental, dental hygiene, or dental assisting programs do not need to make application for a Mississippi Radiology Permit to administer radiographs in dental offices or other entities lawfully authorized to provide dental services while attending the above-referenced programs. However, the Board MUST receive a letter from the dental, dental hygiene, or dental assisting dean or program head certifying as to a student's successful completion of the program's radiology coursework prior to that student administering radiographs in dental offices or other entities lawfully authorized to provide dental services while attending the above-referenced programs. Once such students no longer are enrolled in any of the aforementioned programs, if they wish to continue administering radiographs in Mississippi dental offices or other entities lawfully authorized to provide dental services, they MUST apply for a Mississippi Radiology Permit and ensure compliance with the requirements stipulated in Board Regulation 25. Refer to Board Regulation 25 for more information regarding the application for and issuance of Mississippi Radiology Permits.

Does a licensed specialist need a disclaimer when listing services provided?

No. However, a licensed specialist must indicate the ADA-recognized specialty in any advertisement wherein services provided are included. Refer to Board Regulation 43.

Does a general dentist need to use a disclaimer if he/she lists services performed in an advertisement?

No. However, when a dentist notes any services rendered, the dentist must note in the advertisement that he/she is a "general dentist." The word "family" may be substituted for "general." Also, ALL advertisements MUST include the full name and degree of the dentist who will be providing services. Refer to Board Regulation 43 and the ADA Code of Ethics.

Are dental auxiliaries allowed to perform brush biopsies?

No. Licensed Mississippi dental hygienists and dental assistants are not allowed to perform brush biopsies. Refer to Board Regulation 13.

Are dental hygienists allowed to perform gingival curettage with Biolase?

No. Licensed Mississippi dental hygienists are not allowed to perform gingival curettage with Biolase; however, licensed Mississippi dentists may use Biolase for gingival curettage. Refer to Miss. Code Ann. §73-9-3 and Board Regulation 13.

If I am a contract worker for the military and work outside the State of Mississippi, do I remain on active status?

No. Licensees working as contract workers for the military are NOT considered as "active duty" military personnel; as such, they are listed on inactive status while they are practicing outside of the State of Mississippi. Refer to Miss. Code Ann. §73-9-19 and Board Regulation 49.

Are licensed Mississippi nurses allowed to administer local anesthetics in the dental office?

No. Only a licensed Mississippi dentist may administer local anesthetics in the dental office. Refer to Board Regulation 29 for more detailed information as to the administration of anesthesia.

Can dental auxiliaries administer local anesthesia?

No. Only currently licensed dentists may administer local anesthesia. Refer to Board Regulation 29.

May dental assistants use ultrasonic instruments?

No. Only licensed dentists and dental hygienists may use ultrasonic instruments. Refer to Board Regulation 13.

Do dental assistants need to be licensed by the Board prior to performing dental assisting procedures?

No. The Board does NOT license dental assistants in the same manner in which it licenses dentists and dental hygienists. Dental assistants may be hired by licensed Mississippi dentists to perform those procedures allowed by the Board's laws and regulations to be delegated to dental assistants, EXCEPT EXPOSING RADIOGRAPHS, without the necessity of being licensed or permitted to do so by the Board. If, however, a dental assistant will be EXPOSING RADIOGRAPHS as part of his/her dental assisting duties, that dental assistant must apply for and be issued a valid Mississippi Radiology Permit PRIOR TO exposing any radiographs. Please refer to FAQs for Radiology Permits for more information regarding the application for and issuance of Mississippi Radiology Permits.

If I receive more than the minimum continuing education hours, may I "carryover" additional hours to the next reporting period?

No. There is no "carryover." It is recommended that dentists and dental hygienists receive a minimum of twenty (20) and ten (10) hours, respectively, each year to ensure that they do not lapse in meeting continuing education requirements.

Can I obtain my continuing education in any area I choose?

No. To fulfill the forty (40) required continuing education hours during the two-year reporting period, licensed dentists shall obtain a minimum of twenty (20) hours of clinical continuing education. To fulfill the twenty (20) required continuing education hours during the two-year reporting period, licensed dental hygienists shall obtain a minimum of ten (10) hours of clinical continuing education. Clinical continuing education is defined as personal attendance at clinical courses pertaining to the actual delivery of dental services to patients. All continuing education courses must be approved or sponsored by one or more of the organizations noted in Board Regulation 41.

Am I required to maintain my CPR while on inactive status?

No. While you are on inactive status and NOT working in the dental profession in the State of Mississippi, you are not required to maintain CPR. However, any dentist or dental hygienist requesting active status must, within the previous twelve (12) months prior to requesting active status, be certified in Cardiopulmonary Resuscitation. Refer to Board Regulation 45.

Which dental professionals are allowed to "clean teeth"?

Only a licensed dentist or dental hygienist may "clean teeth." Under no circumstances may dental assistants be allowed to scale or remove "calcareous deposits," which have been defined as "dental calculus, both subgingival and supragingival." Refer to Miss. Code Ann. §73-9-3 and Board Regulation 13.

Who may place subgingival medicated cords?

Only licensed dentists may place subgingival medicated cords (e.g., Actisite). Additionally, at its 07/29/2016 meeting, the Board considered a request from Mississippi Delta Community College's (MDCC) dental hygiene program regarding the difference between an "antimicrobial agent" and an "antimicrobial fiber." At that meeting, the Board re-affirmed the stipulation in Board Regulation 13 and follow-up determinations that the only dental auxiliary who can place antimicrobial fibers and agents are licensed Mississippi dental hygienists; however, no dental auxiliaries are allowed to place epinephrine-impregnated retraction cords. Refer to Board Regulation 13.

What CPR courses fulfill the requirements of Board Regulation 45?

Participation in approved Advanced Cardiac Life Support (ACLS), Pediatric Advanced Life Support (PALS), American Heart Association (AHA), or American Red Cross (ARC) courses may be used to fulfill the requirements of this Regulation. All other equivalent courses shall be approved by the Board on a case-by-case basis; however, in no instance shall any course be approved by the Board that does not contain a hands-on mannequin component. Refer to Board Regulation 45.

How often does the Board administer these clinical assessments?

The Board administers clinical assessments a minimum of twice each year, e.g., during the annual licensure examinations, and typically at the University of Mississippi Medical Center School of Dentistry. However, clinical assessments may be administered elsewhere at the discretion of the Board. Refer to Board Regulation 49.

What equipment must I have to administer enteral conscious sedation and pass the required site visit?

The Board's Enteral Conscious Sedation Permit Site Visit Form is on the Board's web site in the section entitled "Applications and Forms." Many of the same equipment and drugs are required to administer enteral conscious sedation as are required for general anesthesia and parenteral conscious sedation, and you should thoroughly familiarize yourself with the required equipment, supplies, drugs, and written documentation. Also, feel free to contact the Board's office to have the site visit form faxed or mailed to you. Refer to Board Regulation 29 and the Board's Enteral Conscious Sedation Permit Site Visit Form.

What is the convenience fee that is included with my renewal assessment?

The convenience fee is an amount assessed by the State of Mississippi (NOT THE BOARD) for use of its on-line portal. This convenience fee is split among the State's payment processor, your credit card provider, and the State of Mississippi (NOT THE BOARD). This fee is based upon the total amount being renewed, and the most cost-effective manner to renew is via electronic funds transfer (EFT), inasmuch as this fee is a set fee of approximately $1.25 regardless of the amount being renewed. THE BOARD DOES NOT RECEIVE ANY PORTION OF THE CONVENIENCE FEE.

What is the reporting period for continuing education, and how many hours of continuing education do I need?

The reporting period is two (2) years. At its 02/01/2013 meeting, the Board amended item number 1 of Board Regulation 41 to stipulate that the continuing education reporting period runs from January 1 through December 31 of each year, i.e., the reporting period was changed from a renewal based cycle to a calendar year based cycle. This change in the reporting period was made at the behest of many dental and dental hygiene licensees, inasmuch as these licensees felt a calendar year reporting period not only would allow greater flexibility for licensees, but also would be easier for licensees to remember, thus ensuring better compliance. This change in the continuing education reporting period becomes effective 01/01/2014. Dentists must obtain a minimum of forty (40) hours of continuing education for the two-year cycle, and dental hygienists must obtain a minimum of twenty (20) hours of continuing education for the two-year cycle. Refer to Board Regulation 41

What is an Enteral Conscious Sedation Permit?

This is a permit for conscious sedation that is achieved by administration of pharmacological agents through the alimentary tract either orally or rectally. Refer to Board Regulation 29.

How do I know if my on-line renewal was successful?

Within one (1) hour of finalizing payment for your license/permit renewal, you will receive a payment confirmation sent to the e-mail address you provided during the payment portion of your on-line renewal. This e-mail address may be different from the e-mail address(es) you provided during the data portion of your on-line renewal. Anesthesia permit holders and DANB-certified dental assistants will be required to submit additional documentation before their renewal can be finalized, and instructions as to submitting this supplemental documentation will be provided in the payment confirmation e-mail.

Does the substitute Advanced Cardiac Life Support (ACLS) course developed by the American Dental Association (ADA) fulfill the requirements of Board Regulation 29?

Yes, but not for all anesthesia permits. At its 11/18/2011 meeting, the Board approved the substitute ACLS course developed by the ADA for use in fulfilling the ACLS requirements for Enteral Conscious Sedation and Parenteral Conscious Sedation Permits as stipulated by Board Regulation 29. This course was NOT approved as a substitute ACLS course for General Anesthesia Permits. Refer to Board Regulation 29.

Are Mississippi's dental hygiene schools allowed to teach local anesthesia to their dental hygiene students in light of the Board NOT ALLOWING the administration of local anesthesia by dental hygienists licensed by the Board?

Yes, but with STRICT limitations. At its 04/21/2015 meeting, the Board considered a request from the University of Mississippi Medical Center (UMMC) School of Dental Hygiene to teach the administration of local anesthesia to the level of LABORATORY COMPETENCY and NOT clinical competency. The Board voted to ALLOW the instruction of local anesthesia administration at all Mississippi accredited dental hygiene schools ONLY to the level of laboratory competency and ONLY by currently licensed Mississippi dentists who are faculty members. In other words, no local anesthesia will be administered by dental hygiene students either on the general public or fellow students enrolled in such dental hygiene programs.

Are dental auxiliaries allowed to start nitrous oxide under the direct supervision of a licensed Mississippi dentist?

Yes. A dentist currently licensed by the State of Mississippi may instruct a competent dental auxiliary as to the placement and monitoring of nitrous-oxide inhalation anxiolysis under his/her direct supervision. These dental auxiliaries must, at all times, be currently certified in Cardiopulmonary Resuscitation. Remember, too, that any patients under nitrous oxide must be continuously monitored. Refer to Board Regulation 29 for additional information regarding administration of anesthesia and Board Regulation 45 for additional information regarding Cardiopulmonary Resuscitation.

Is the course offered by the Dental Organization for Conscious Sedation (DOCS) considered as an approved course to fulfill the requirements for an Enteral Conscious Sedation Permit?

Yes. All courses, however, must be approved by the Board. For patients patients who are 12 years of age or under, or who are 13 years of age or older AND who are deemed to be patients with special health care needs, the minimum number of didactic hours shall be 50, with a minimum of 25 hours pediatric-specific, and the minimum number of clinical patient cases shall be 10, with a minimum of 5 being pediatric clinical patient cases. For patients who are 13 years of age or older and who are NOT deemed to be patients with special health care needs, the minimum number of didactic hours shall be 22, and the minimum number of clinically oriented experiences shall be 15. The training program must include physical evaluation, enteral conscious sedation, airway management monitoring, and emergency management. The preceding is necessary for recognition of the formal training program, and training programs in enteral conscious sedation that satisfy the requirements described in Parts I and III of the ADA's "Guidelines for Teaching Pain Control and Sedation to Dentists and Dental Students" at the time training was commenced, shall be deemed by the Board as approved training programs, wherein the hours of didactic training and the number of clinical patient cases shall be credited to the minimum amounts noted above. Refer to Board Regulation 29.

Does my staff require additional training for me to hold an Enteral Conscious Sedation Permit?

Yes. All dental auxiliaries having direct patient care responsibilities are required to be current in CPR at all times. However, dental auxiliaries in offices wherein any anesthesia requiring a permit is administered also must be trained to reasonably assist the dentist with procedures, problems, and emergencies. Refer to Board Regulation 29.

Are dentists, dental hygienists, and dental assistants required to maintain CPR?

Yes. All dentists and dental hygienists licensed by the State of Mississippi and holding active licenses shall be currently certified in Cardiopulmonary Resuscitation. Further, all auxiliary personnel involved in direct patient care must be certified in Cardiopulmonary Resuscitation. All auxiliaries must be certified in CPR within one hundred eighty (180) days of employment. Refer to Board Regulation 45.

Once I have been issued a Mississippi anesthesia permit, will I be subject to periodic site visits from the Board?

Yes. All facilities wherein anesthesia requiring permits is administered shall be inspected at least once every five (5) years beginning with the permit issue date, or as designated by the Board, to ensure all equipment is appropriate and in good working order. Refer to Board Regulation 29.

Is Advanced Cardiac Life Support (ACLS) required for an Enteral Conscious Sedation Permit?

Yes. An applicant applying for any kind of Mississippi anesthesia permit is required to produce evidence of a current ACLS certificate; however, Pediatric Advanced Life Support (PALS) or a certificate from a Board-approved course also may be used to fulfill the ACLS requirement. Refer to Board Regulation 29.

Are there any drugs that cannot be used in combination with N2O2 for anxiolysis purposes?

Yes. As previously noted, all drugs should be label specific or in peer-reviewed literature. Refer to Board Regulation 29.

Are licensed Mississippi dental hygienists allowed to practice Orofacial Myology without having to work under the direct supervision of licensed Mississippi dentists?

Yes. At its 01/22/2016 meeting, the Board considered a request as to whether licensed Mississippi dental hygienists could practice Orofacial Myology. At that meeting, the Board determined that licensed Mississippi dental hygienists are allowed to provide these services under the direct supervision of licensed Mississippi dentists; however, if dental hygienists advertise the availability of such services and their ability to perform them, such advertisements must not reflect that these services are being performed under the auspices of Mississippi dental hygiene licenses. In other words, if a licensed Mississippi dental hygienist wishes to provide these services without announcing that the individual holds a Mississippi dental hygiene license, the Board has determined that it has no purview in this matter.

Can Mississippi specialists receive continuing credit for successfully completing any required re-certification examinations?

Yes. At its 01/24/2014 meeting, the Board considered a request concerning the American Board of Oral and Maxillofacial Surgeons (ABOMS) 2013 re-certification examination and whether continuing education credit would be allowed for successfully completing this re-certification examination. At that meeting, the Board approved successful completion of the ABOMS re-certification examination for 10 hours of non-clinical continuing education credit for Mississippi Oral & Maxillofacial Surgeons who are board-certified within their specialty. Further, with respect to all ADA-recognized specialties stipulated in Board Regulation 7, those Mississippi specialists who are board-certified within their ADA-recognized specialty categories also shall receive 10 hours of non-clinical continuing education credit over the two-year reporting period for their 2013 and all future re-certification examinations. Licensees are cautioned, however, to remember the Board's restriction on the number of allowable hours of on-line, home study, and correspondence courses. Refer to Board Regulation 41.

Are dental auxiliaries allowed to adjust the gingival side of complete or partial dentures?

Yes. At its 02/02/2007 meeting, the Board discussed a request for clarification regarding whether dental auxiliaries are allowed to adjust the gingival side of complete or partial dentures. It was the consensus of the Board that, pursuant to the current reading of Board Regulation 13 , gingival side adjustments of partial or complete dentures are allowed to be delegated to dental auxiliaries under the direct supervision of licensed Mississippi dentists.

Are working interviews by dental hygienists who do not hold a currently valid Mississippi dental hygiene license considered as practicing dental hygiene without a license?

Yes. At its 04/01/2016 meeting, the Board considered this issue, inasmuch as questions of this nature have arisen numerous times over the years, and the answer has been NO, albeit no formal Board determination had been made on this subject. Due to continuing questions along these lines, it was decided that a formal Board determination should be made insofar as whether such "working interviews" by those who still may be enrolled in Mississippi dental hygiene school (when such working interviews are not a requirement for graduation), or by those who have graduated from a Mississippi dental hygiene school and who have not been issued a Mississippi dental hygiene license are considered the illegal practice of dental hygiene unless such dental hygienists possess a currently valid Mississippi dental hygiene license. At this meeting, the Board officially determined that dentists and dental hygienists are NOT ALLOWED to practice their respective professions in the State of Mississippi without having been issued a currently valid Mississippi dental or dental hygiene license. Furthermore, this determination pertains to any dentists or dental hygienists who may be participating in "working interviews," such term being defined as rendering dental or dental hygiene treatment to live human subjects in the State of Mississippi.

Are Mississippi licensed dentists functioning as adjunct professors and supervising dental and dental hygiene student externs allowed to bill patients and any third-party payors for all dental treatment rendered by these student externs?

Yes. At its 04/01/2016 meeting, the Board discussed the off-site rural rotation program presented by the University of Mississippi School of Dentistry. The Board voted to approve the proposed off-site rural rotation program and, further, to allow the Mississippi licensed dentists functioning as adjunct professors and supervising these student externs to bill patients and any third-party payors for all dental treatment rendered by these student externs, inasmuch as the Board has determined that such externships do not violate Miss. Code Ann. § 73-9-3(1)(h), which stipulates that the Board may not prohibit: "[d]ental or dental hygiene students enrolled in accredited dental or dental hygiene schools from participating in off-site training recognized and approved by the board, but those activities shall not be carried on for profit..." Additionally, the Board determined the phrase "shall not be carried on for profit" to mean that student externs are NOT allowed to profit monetarily from such externships. The Board further determined that licensed Mississippi dentists supervising such student externs must be physically present in the dental office or treatment facility, personally diagnose the condition to be treated, authorize the procedures to be performed, remain in the dental office or treatment facility while the procedures are being performed, and evaluate the performance of the student extern. The foregoing determination also applies to dental hygiene students authorized to participate in off-site training programs by any Mississippi accredited dental hygiene school, as well.

Are licensed Mississippi dental hygienists allowed to administer Arestin?

Yes. At its 04/06/2007 meeting, the Board determined that licensed Mississippi dental hygienists are allowed to administer Arestin since it is not an antimicrobial fiber, according to the current guidelines of Board Regulation 13, item number 11. Additionally, at its 07/29/2016 meeting, the Board considered a request from Mississippi Delta Community College's (MDCC) dental hygiene program regarding the difference between an "antimicrobial agent" and an "antimicrobial fiber." At that meeting, the Board re-affirmed the stipulation in Board Regulation 13 and follow-up determinations that the only dental auxiliary who can place antimicrobial fibers and agents are licensed Mississippi dental hygienists; however, no dental auxiliaries are allowed to place epinephrine-impregnated retraction cords. Refer to Board Regulation 13.

Does the on-line/mannequin course offered by the National Safety Council (NSC) fulfill the guidelines of Board Regulation 45?

Yes. At its 04/21/2015 meeting, the Board approved the NSC on-line/mannequin course as fulfilling the guidelines for Cardiopulmonary Resuscitation certification in Board Regulation 45, contingent upon all such coursework including a hands-on mannequin component in addition to the on-line coursework to ensure full compliance with Board Regulation 45. Refer to Board Regulation 45.

Does the coursework offered by ProTrainings, LLC fulfill the guidelines of Board Regulation 45?

Yes. At its 05/18/2012 meeting, the Board approved ProTrainings, LLC's Pro-CPR and Pro-First Aid Advanced as fulfilling the guidelines for Cardiopulmonary Resuscitation certification in Board Regulation 45, contingent upon all such coursework including a hands-on mannequin component in addition to the on-line coursework to ensure full compliance with Board Regulation 45. Refer to Board Regulation 45.

Does the Board grant continuing education credit for dentists and dental hygienists administering the clinical licensure examinations?

Yes. At its 05/18/2012 meeting, the Board voted to grant continuing education credit for Mississippi dentists and dental hygienists administering the ADLEX and ADHLEX in Mississippi. This continuing education will count toward fulfilling required clinical continuing education as stipulated in Board Regulation 41. Dentists administering the ADLEX will receive fifteen (15) hours for a two-day examination, and for examinations less than two full days, they will receive 7.5 hours per day. Dentists and dental hygienists administering the ADHLEX will receive six (6) hours for each full day, and for those examinations less than a full day, they will receive three (3) hours for each one-half (½) day. Furthermore, at its 11/16/2012 meeting, the Board determined that it would allow an additional three (3) hours of clinical continuing education credit for successful completion of calibration exercises prior to each licensure examination. For example, dentists who successfully complete the dental manikin calibration exercises will receive three (3) hours of clinical continuing education; dentists who successfully complete the dental restorative calibration exercises will receive three (3) hours of clinical continuing education; dentists who successfully complete the dental periodontics calibration exercises will receive three (3) hours of clinical continuing education; and dentists and dental hygienists who successfully complete the dental hygiene calibration exercises will receive three (3) hours of clinical continuing education.

Are licensed Mississippi dental hygienists and dental assistants allowed to place and pack retraction cords?

Yes. At its 06/16/2006 meeting, the Board reaffirmed a previous determination that licensed Mississippi dental hygienists and dental assistants may place and pack retraction cords under the direct supervision of a licensed Mississippi dentist. However, pursuant to item number 11 in Board Regulation 13, licensed Mississippi dental hygienists and dental assistants may not place any subgingival medicated cords; although, the placement of periodontal treatment agents may be performed by licensed Mississippi dental hygienists.

Are out-of-state dental and dental hygiene students allowed to complete any required clinical external rotations in the State of Mississippi?

Yes. At its 07/29/2016 meeting, the Board considered a request from the Arizona School of Dentistry & Oral Health regarding whether one of that School's fourth-year dental students would be allowed to complete his/her required clinical external rotation program in Mississippi. At that meeting, the Board determined that the Arizona School of Dentistry & Oral Health's fourth-year dental students who have fulfilled the School's requirements to be eligible for clinical external rotations may complete such rotations in the State of Mississippi pursuant to the requirements set forth in Miss. Code Ann. § 73-9-3(g) and (h) and Board Regulation 3, which sets forth requirements for regulating individuals with less than full licensure. Furthermore, the Arizona School of Dentistry & Oral Health must ensure compliance with all requirements by the Commission on Dental Accreditation (CODA) regarding clinical external rotations, and it must submit a detailed report to the Board specifying the names of all dental and dental hygiene students, as well as their designated adjunct professor(s), a minimum of thirty (30) days prior to the actual commencement of the clinical external rotation. Additionally, this clinical external rotation approval and reporting requirement extends to all CODA-accredited dental schools and dental hygiene schools. Refer to Refer to Miss. Code Ann. § 73-9-3(g) and (h) and Board Regulation 3.

Are licensed Mississippi specialists allowed to employ dental hygienists to perform dental hygiene procedures, such procedures being provided pursuant to the Board's laws and regulations?

Yes. At its 07/29/2016 meeting, the Board determined that all licensed Mississippi specialists are allowed to hire and utilize the services of licensed Mississippi dental hygienists as those services fall within the definition of dental hygiene stipulated by Miss. Code Ann. § 73-9-5, the Board's Regulations, and the appropriate Board determinations. Refer to Miss. Code Ann. §73-9-5, Board Regulation 13, and FAQs for dental scope of practice.

Are dental auxiliaries allowed to make the Essix vacuum permanent retainer?

Yes. At its 07/31/2015 meeting, the Board determined that dental auxiliaries are allowed to make the Essix vacuum permanent retainer, inasmuch as the Board does not consider this to be the activation or adjustment of orthodontic appliances, such activation or adjustment being prohibited by Board Regulation 13.

Are dental auxiliaries allowed to perform Face Bow procedures, and, if so, is prior training in Face Bow required?

Yes. At its 08/10/2012 meeting, the Board determined that dental auxiliaries are allowed to perform this procedure without prior training being necessary.

Does the coursework offered by the American Safety & Health Institute (ASHI) fulfill the requirements of Board Regulation 29?

Yes. At its 08/19/2011 meeting, the Board approved ASHI's ACLS and PALS coursework as fulfilling the requirements in Board Regulation 29 for the application for and renewal of anesthesia permits. Refer to Board Regulation 29.

Is the word "affordable" allowed in dental advertisements?

Yes. At its 09/13/2002 Board meeting, the Board made the following determination with respect to use of the word "affordable" in advertising: The Mississippi State Board of Dental Examiners has recently re-evaluated its position as to use of the word "affordable" in dental advertising and signage, and whether use of such a term would be in violation of Board Regulation 43, prohibiting any advertisement deemed to be misleading to the public. Although, previously, the Board determined that use of the term "affordable" may be misleading, i.e., what is affordable to one person may not be to another, the Board has determined, based on advice of legal counsel, not to prohibit use of the word "affordable" in advertising and signage, provided all other aspects of the advertisement and/or signage comply with Board Regulation 43.

Is a dentist required to conduct an initial oral examination on all new patients-of-record before referring these patients to the dental hygienist for treatment?

Yes. At its 11/03/2006 meeting, the Board determined that a dentist must conduct an initial oral examination on all new patients-of-record prior to referring them to the dental hygienist for treatment. Additionally, at its 02/02/2007 meeting, the Board further clarified its 11/03/2006 determination regarding procedures a dental hygienist is allowed to perform on new patients-of-record before the dentist conducts an initial oral examination on these patients. The Board determined that a dental hygienist is allowed to take the health history and blood pressure; however, no intraoral procedures or radiographs shall be performed by the dental hygienist on any new patients until the dentist performs an initial oral examination prior to referring these new patients for dental hygiene treatment. On 08/01/2008, the Board was requested to clarify this determination as it relates to dental, dental hygiene, and dental assisting teaching institutions. The Board noted that for private sector dental practices and dental, dental hygiene, and dental assisting teaching institutions, the Board expects the dentist to perform a cursory examination prior to any treatment being rendered to the patient which would involve any intraoral procedure on new patients of record prior to referring them for dental hygiene treatment. At the 2/22/2019 meeting, the Board determined that the requirement that the dentist must perform an initial exam on a new patient of record before the hygienist can begin treatment has been rescinded. The hygienist can begin treatment.

May computer-based, home-study, correspondence, or video courses be used to fulfill continuing education requirements?

Yes. Continuing education credit will be given for computer-based courses, video courses, audio courses, reading, and/or correspondence/home study courses on a limited basis. All such courses shall be sponsored/approved by any one or more of those organizations listed in Regulation 41, or licensed dentists and dental hygienists may obtain prior Board approval of any such courses on a course-by-course basis. Effective with the Board's 05/18/2012 amendment, dentists and dental hygienists are limited to a maximum of twenty-five percent (25%) of this type of continuing education per two-year continuing education reporting period (prior to the 05/18/2012 amendment, only four [4] hours were allowed). At its 10/16/2015 meeting, the Board amended Section 6 of Board Regulation 41 to effect an exemption to the 25% maximum for webinars providing live interaction among the course presenter and participants. Furthermore, a post-study examination must be a part of any of the courses, including the aforementioned exempted webinars, and licensed dentists and dental hygienists shall ensure they successfully complete and retain a copy of such post-study examination and any other documentation stipulated by Board Regulation 41.

Can dental auxiliaries perform tooth whitening procedures?

Yes. Currently licensed dental hygienists and dental assistants may perform tooth whitening procedures under the direct supervision of a currently licensed dentist.

Can dental auxiliaries place sealants?

Yes. Currently licensed dental hygienists and dental assistants may place sealants under the direct supervision of a currently licensed dentist.

Are Automated External Defibrillators (AED) required in dental offices?

Yes. Effective 07/01/2012, all dental offices in the State of Mississippi shall be required to have a minimum of one (1) properly functioning AED, or equivalent defibrillator, on the premises of each dental office. Each AED, or equivalent defibrillator, shall be maintained in a properly functioning capacity at all times. Proof of the availability of a properly functioning AED, or equivalent defibrillator, shall be made available for review at any time by any member of the Board or by any designated agent of the Board. Refer to Board Regulation 45.

I have been using a "corporate/trade" name for my dental clinic for many years. Do I still need to register that name with the Board?

Yes. It is immaterial whether you have used a "corporate/trade" name for one (1) or twenty (20) years -- you still must register that name with the Board; otherwise, you are in violation of the laws and regulations pertaining to advertising. Refer to Board Regulation 55.

If I am retired or on the inactive list, do I need to renew my license each biennial renewal period?

Yes. License renewal occurs from September 1 through October 31 each biennial period, and all licenses not renewed by October 31 are assessed penalties from November 1 through December 31 during the renewal period. There are no exceptions to penalty assessments. Any licenses not renewed by December 31 each year will be voided on January 1 for a failure to re-register. Refer to Miss. Code Ann. §§73-9-19 and 73-9-43 and Board Regulation 37.

Are dental auxiliaries allowed to apply topical anesthetics?

Yes. Licensed Mississippi dental hygienists and dental assistants may apply topical anesthetics under the direct supervision of a licensed Mississippi dentist. Refer to Board Regulation 29 for additional information regarding administration of anesthesia.

Are dental auxiliaries allowed to use the Kavo Diagnodent?

Yes. Licensed Mississippi dental hygienists and dental assistants may use the Kavo Diagnodent under the direct supervision of a licensed Mississippi dentist. Refer to Board Regulation 13.

Can I use a drug in a dosage for a purpose that is not on the package insert or Food and Drug Administration (FDA) labeling?

Yes. Licensed Mississippi dentists may utilize drugs in accordance with the drug manufacturer's guidelines as set forth in FDA-approved labeling or peer-reviewed scientific literature, including, but not limited to, indications of usage, dosage amounts, and safety requirements for each drug so utilized. Refer to Board Regulation 29.

Do radiology permit holders have to request active status?

Yes. Radiology permit holders DO NOT need to submit the documentation required for dentists and dental hygienists to return to active status. Radiology permit holders simply need to submit a written request providing the name(s) and address(es) of the Mississippi dentist(s) for whom they will be working

In reading Miss. Code Ann. § 73-9-5(2) regarding "recognized" dental hygienists being allowed to practice under the general supervision of licensed Mississippi dentists while making public demonstrations of dental hygiene for educational purposes, has the word "recognized" been defined by the Board?

Yes. The word "recognized" was defined by the Board via amendments to Board Regulation 13 adopted at the Board's 04/21/2015 meeting. In the section entitled "Supervision and Recognition of Dental Auxiliaries," the Board added a new item 3, specifically to define the word "recognized" as it pertains to the general supervision of Mississippi dental hygienists. Refer to Board Regulation 13 for the complete text of this definition, as there are strict limitations in such circumstances for both the licensed Mississippi dental hygienist and the licensed Mississippi dentist providing the general supervision.

If I am retired or on the inactive list, do I need to pay a license renewal fee and the assessment for the Professionals Health Network (PHN)?

Yes. There are no reduced fees for inactive or retired status, and the PHN assessment is mandatory for all dentists and dental hygienists who wish to renew licenses. Refer to Miss. Code Ann. §73-9-43 and Board Regulation 37.

In light of the Board's 11/16/2012 determination regarding dental hygiene students, does the Board require DIRECT supervision when dental assisting students practice (role-play) with each other while enrolled in Mississippi dental assisting schools?

Yes. This is different from the 11/16/2012 determination regarding dental hygienists. At its 04/21/2015 meeting, the Board considered a similar request from Meridian Community College's dental assisting program as to whether direct supervision, which has been defined in Board Regulation 13, is required for dental assisting students practicing (role-playing) on each other and NOT on the general public. At that meeting, the Board determined that dental assisting students are NOT allowed to practice dental assisting procedures under the guidelines in the Mississippi Dental Practice Act (MDPA) on fellow dental assisting students and the public-at-large while actively enrolled in a Mississippi dental assisting program without a currently licensed Mississippi dentist being present in the facility. In other words, a currently licensed Mississippi dentist must be present in the facility at all times while procedures are being performed on both students and the public-at-large. Refer to Board Regulation 13

Is a permit required for dental assistants to administer radiographs?

Yes. Under no circumstances may a dental assistant administer radiographs without the appropriate radiology permit. Also, dental hygienists who are graduates of ADA-accredited dental hygiene programs, who are not licensed in Mississippi, and who are working in Mississippi as dental assistants must have radiology permits before administering radiographs. Refer to Board Regulation 25.

If I am listed as inactive, how do I change to active status?

You must make a written request to the Board, and you must supply the appropriate proof of continuing education and certification in Cardiopulmonary Resuscitation within the twelve-month period prior to requesting active status. Upon receipt of your written request and attached documentation, your request will be submitted to the Board for approval. Under no circumstances are you to practice as a dentist or dental hygienist in the State of Mississippi until you receive written verification that you have been placed on the active list. If you were unable to provide the name(s) and address(es) of Mississippi dentist(s) for whom you will be working with your initial request to return to active status, once the Board has approved your request, you will be allowed, as a courtesy, sixty (60) days to remain on active status while finalizing your Mississippi dental employment. If you have not provided your Mississippi dental employment information to the Board within the sixty (60) day period, you will be returned to inactive status until such time as you have complied with all active status requirements. Refer to the following Board Regulations: Board Regulation 41, Board Regulation 45, and Board Regulation 49.

How do I maintain my active status?

You must work a minimum of three (3) months during the preceding license renewal period in the State of Mississippi. The Board has determined that working a minimum of one (1) day in any three (3) months of the preceding license renewal period will enable a licensee to maintain his/her active status. The three (3) months do not need to be consecutive. Refer to Board Regulation 49.
