Information disclosure authorization forms

An insurer or agent may not use as its disclosure authorization form one that authorizes the disclosure of personal or privileged information about an individual to the insurer or agent unless the formspecifies the types of persons authorized to disclose information about the individual;specifies the nature of the information authorized to be disclosed;

An insurer or agent must clearly specify those questions designed to obtain information solely for marketing or research purposes.

Correction of recorded personal information

An insurer or agent must correct, amend, or delete any recorded personal information about the individual within 30 business days from the date of request or notify the individual of its refusal to make a correction, amendment, or deletion and the reasons for the refusal

Limitations on disclosure of recorded personal information

An insurer or agent must not disclose privileged information

Individual access

If any individual submits a written request to an insurer or agent for access to recorded personal information, the insurer or agent must, within 30 business days

Investigative Consumer Report

Similar to consumer reports in that they also provide information on the consumer's character, reputation, and habits.

Penalties

a fine of no more than $10,000 for each violation;a fine of no more than $50,000 if the violations constitute a general business practice; ora suspension or revocation of an insurer or agent's license
